Jaffa cakes... or biscuits?

My DC7 saw this recently, and asked...
'Well, why are they in the biscuit section then?' 😄

What's your opinion (we all know they are officially classed as 'cakes' by McVities) as to why they're in the biscuit aisle?

This was actually hashed out in court. They're cakes. The deciding factor was what happens when it goes stale. Biscuits go soft when stale. Cakes goes hard. Jaffa cakes go hard, ergo: cakes.

They are cakes in the eyes of the law. There was a court case on it. It’s all about the vat.

Yep ds told me about this. I said maybe they should have floated which aisle they were in, in the opposite direction.

I believe there may be as similar problem with the M and S strawberries and cream sandwiches? Not subject to VAT as a sandwich but does that mean anything can be put between 2 slices of bread and not attract VAT?
I think someone on SM was selling a T-shirt sandwich or similar to make the point

For decades people have plucked Jaffa cakes from the biscuit aisle. It might lead to civil unrest if they put them in the cake aisle.

@ChippySauce I saw them yesterday in a large M and S. The assistant said they sell out every day and you have to be there before lunchtime to get them

Whether legally they are a cake, I think they are a biscuit.

They are cakes because of what everyone says above. But they are placed with biscuits are biscuits are their natural competitor - you’re more likely to be choosing between rich tea or Jaffa cakes than Jaffa cakes or Victoria sponge. Although how they are marketed (in the biscuit aisle) is a relevant argument that they are biscuits for VAT purposes.

If you’re really interested in VAT cases, there was a recent one that found Walkers (I think?) Poppadoms were actually crisps and not Poppadoms. There may also be a Pringles crisps vs not a potato snack case.

My friend, who LOVES jaffa cakes (she buys numerous boxes per shopping trip, and gets them as part of her birthday presents 😂) and I did a taste test!
She prefers the aldi ones. I like the M&S ones (rectangular shape and much thinner).
