I just reversed into a car which has no insurance, tax or MOT. What happens now?

driving home, residential streets with lots of parked cars obstructing views...edged out of a t-junction to turn left. there was a car coming down the road, so I reversed back....into the car which had followed me out of the junction.

his car is scuffed over the passenger wheel arch (mostly paint transfer from my car) and I have quite a crunch to the right back corner

he was really cross and wanted me to bank transfer him money to repair his car. which I declined and said I want to go through insurance (as I'm skint), gave him my name, number and registration. I have his registration and phone number.

I have checked online and the vehicle tax expired in march 2024, MOT expired march this year. so he has no insurance. what will happen now?? I am not planning on telling my insurance company unless he makes a claim because I am financially really really struggling and don't want my premium to increase

Yeah no arguments that he should have insurance and MOT. However we don’t have the full context here about why there was no MOT. And if it’s morally fine for the OP to lie to her insurers and exploit his lack of insurance, how is she any better than he is? What if he was skint and couldn’t afford his MOT? If you can justify committing insurance fraud due to being skint why can’t you also then justify failing to insure your car for the same reason?

Cut past who? You were maneuvering left he was going right. And your now saying he was on the wrong side of the road turning an opposite direction to you- so if you simply reversed back a bit (you being on the correct side of the road) how did you hit him if he was on the other side of the road?

The police won’t be in the slightest bit interested but can direct him to your insurer- you may as well do it yourself.

maybe he intends to tell the police he was on the way to the garage to get the mot work done- I mean maybe he was. That’s a legit as reason to drive with no insurance/ MOT

Only if it's a pre-booked MOT appointment.

Skint by having a BMW, he is definitely a chancer. It's been over a year since his MOT and tax. Definitely dodgy.

Regardless of the dickhead he was afterwards, YOU are at fault
So actually, dashcam footage would be in his favour, showing who was actually at fault for the accident

How does this work if he is already acting illegally by being on the road with no tax/insurance?

Surely he should not be doing that in the first place and this is the risk he took.

The problem is that you are a dishonest liar who genuinely wanted to tell the insurance company a pack of lies about him hitting you from behind because you were skint and didn’t want to pay an increase in premiums. You caused the accident and should take responsibility. He might not claim from you but I do hope he does.

nope, I haven't said that I wanted to tell the insurance company a pack of lies. my approach was not to tell the insurance company and I was asking if he was going to be able to make a claim if he was uninsured/untaxed with no MOT. Hoping that his illegal status would work in my favour and he wouldn't be able to claim.

I have learnt that he can make a claim without being insured himself. and also that I need to inform my insurance company even if no claim is happening (although I am not clear as to why they need to know, if no one is asking them to pay anything to anyone)

He won't want to pursue it officially, and the person behind is assumed to be at fault so unless you're admitting to reversing into him or there was CCTV he'd struggle to pin it on you.

Wow, you are getting railed OP, so many triggered people on here? 🤔Don't speak to the guy any further. While I understand you rolled back into him, I hate people who drive with no MOT/tax/insurance even more. Regardless of his MOT, tax, insurance status, advise him to contact HIS insurance provider using the details you gave him, and they will help him make a claim. Leave it at that, then block him. I bet you won't hear from him again, and do not give him money! Him asking you for money makes him a chancer.

I think that's when you dont leave enough space between you and the car in front and you crash into the car in front. But if someone reverses into your car (particularly if you are stationary) then why would that be your fault?

no. I said, yeah that is what I will do in response to telling the insurance company/letting them deal with it/blocking his phone number. I wasn't meaning that I would tell them he hit me

And the reason insurers want to know is because they take the view that if you're involved in a collision - even if it's not your fault - you are more likely to be involved in another one (it's part of the risk analysis insurers do, which seems unfair, but they hold all the cards so we just have to suck it up).

😂😂 I can’t see anyone defending him, only people correctly pointing out that regardless of his vehicle, YOU were in the wrong in causing the accident.

You seem to think that what you did doesn’t matter if he also did something wrong which isn’t the case, you’re both in the wrong.

You also started off acknowledging you were in the wrong, and as it’s gone on you’re now changing the story to suit your narrative, hence it doesn’t look great for you!

Some of us aren’t saying that at all. Most posters have said to contact your insurer. He absolutely should have tax and mot but you can be the more responsible person by doing it right from your end.

But we’re all cunts obviously. 🙄
