I need to send papers/court documents but I don't have the person's address

I will be coming to a situation where I will need get help with taking some civil action and send papers to someone for a case. However I don't have the person's address. I have a general idea and location of her.

What happens in cases like this? Do I need to go to the police to see if they can find her? Or will I ask some mutual people I know if they have her address or if they can get it for me but not without telling her.

I don't have her work address. I do have the old work address. Would I be able to send papers there? Would she deny getting papers if they were sent to her old work address? She likely would still get them.

I hope to take civil action seeking a court order.

Is it a small claim court claim?

Craftycariad · 28/11/2024 20:16

You can not issue court paperwork on a person if you don't know where they are. The court will require an address on them. You can get a private investigator to find the address if the suggestions you have made do not get what you need. Only you can decide if the cost of that is worth it. If you have joint friends maybe they can help

No, it will be district court.

Yes, that's right. I know I likely won't be able to serve any papers on someone like this without an address.

Should I talk to a few mutual people and see if they can get an address for me.

I do think I may have a general location to her. She wrote a few times about stuff online and I was able to check Google maps and I do think I have a general location of the person. I definitely know the county and I can narrow it down to a street in a city.

I can’t imagine that the police would be able to disclose personal information

How much would a private investigator cost? I kinda do have a general location to where she could be.

Hire a private investigator. It was surprisingly cheap when I needed to do it. I hired one to investigate someone’s criminal record, so bit more involved, but was about £80.

Get yourself some 192.com credits. If she's on the electoral roll, she should be locatable using that.

DiamondGoldandSilver · 28/11/2024 20:24

Is she a company director? Sometimes their home addresses are available on companies house

She is on the electrol roll because it's going to her very old address so that's sadly not an option. Unless if she updated the electrol roll to where she is. I don't think she votes. I know of her online profile and forum posting and she's not political. I don't think she votes.

You're allowed to serve to the last known address. Which may not be their current address.

Sounds a bit intense! I would be very v pissed off with you as a friend if you used me to take another friend to court!

What a strange thing to say. I never post anything political on social media nor do any of my family or friends but we all still vote.

DiamondGoldandSilver · 28/11/2024 20:32

Do you come across her in person, ie do you know where she works or her regular movements? You could hire a process server to serve in person and they will prepare a simple affidavit of service. It’s not very expensive

I know she she moved about 2 to 3 years ago. I don't know if she would get papers if I was to send them to her last address. She could also easily ignore them but then in that case would likely be successful in court.

You do t know the crap she put me through. Years of hell and torment. I had an arguement with her one night which was just that. She blew it all up. 10 years of hell and stalking and harassment from her. The police refused to help me. I was ignoring for years but her anger is still as fresh today as it was 10 years ago. You would swear I killed her cat but I didn't. You do not know the hell I am living from her.

OK not in the spirit.... but is this woman you wanted legal advice about employment law because you thought your partner met her at her work and was cheating, or the legal advice you wanted about re a restraining order against a former friend?. Lots of legal issues!!

I know her account on a different forum and I know she never takes part in anything political. She has no interest in anything political at all.

Ah the former friend? Why want to find her when you're asking for a restraining order?

Sheriff officers usually offer a "trace" system. Or a service system. Call your local ones and ask.

So please serve this on x, last known address y, ok madam. Here is the fee.

Or where does x live. They conduct a trace. Here is fee

Yes. That's right. I am going down the route of seeking an order from the court to stop harassment. She will not leave me alone. Ever. She thinks she has a right to me and to be angry with me even though and to punish me over and over when she's someone who's just not in charge of her own emotions, feelings and reactions and keeps lashing out and I am her target.

I will need an address to serve papers.
