Work hasn't paid me ....

justflewinfromthewindycity · 30/08/2024 07:41

I posted last week about a new job as a receptionist/no breaks after 8 hours/no notice of shits etc
I quit after a day and today should have been pay day.
They haven't paid me
I should of received £100
I had no notice period
Is it legal for them not to pay me?

Make sure you get confirmation when you take the shirt back. I used to work somewhere with a uniform and I know it wasn't cheap to replace when leavers didn't return their items, it was easy to wash and save them for future staff.

I think they send uniforms of to be recycled for use again

Biggaybear · 30/08/2024 10:26

You sound very young OP. Flouncing out after just 1 day and not returning your work uniform. How about giving something a go.....maybe a week or two just to he sure.

And if they dont pay you once you've returned the shirt then just chalk it up to experience.

justflewinfromthewindycity · 30/08/2024 10:31

@Biggaybear I have a longstanding anxiety disorder and this was my first job after having a mental breakdown
Which kept me in the house unable to leave for quite a while
I rushed into a full time job and after the two days realised it was too much after having panic attacks
This job had no breaks after 8 hours
No set shifts and it was just too much
I posted about it in my last thread

Im sure different places do different things, where I worked they were reused maybe as spares or temp uniform for new starters or when someone needed a different size

@TheBottomsOfMyTrousersAreRolled I've just put it in the washing machine, will iron it and take it back in

But remember you are owed two days pay, not one.

bluelavender · 30/08/2024 10:50

They need to pay you the minimum wage (or the amount they agreed with you in a contract if higher)

You can get advice from Acas
https://www.gov.uk/pay-and-work-rights

Mumsgirls · 30/08/2024 12:03

Someone tried this with my daughter and messed her about after working in an abusive setting for 4 days. We told them that I would come to the office the following day and they should have a cheque waiting. Otherwise they would be reported to ACAS and or DWP. The cheque was waiting. There are strict laws about being paid and the government take a very dim view of breaches like this and you need two days not one. They will pay you, as they won’t want the trouble. No they cannot hold your pay hostage for a cheap shirt. They are trying to bully you, tell them to send you p and p costs and they can have it

DeclutteringNewbie · 30/08/2024 13:07

Neither ACAS nor DWP can enforce pay, but well done……

FlemCandango · 30/08/2024 13:17

ACAS can help enforce a pay dispute as they are involved in the process for a employment tribunal. First return the shirt and write a polite email asking for payment for your days at the job. Then if necessary consider escalating to early reconciliation with Acas if they fail to respond and pay you. This needs to be done within 3 months minus 1 day of when they first failed to pay you.
If they do not respond to the mediation offered through ACAS then you can go to employment tribunal.

A pay dispute can go to ET even if you only worked there a couple of days.

@DeclutteringNewbie thanks for the English lesson Wink

Not a bad thing to get a grip on basic grammar though when looking for a new job.

Indeed. But the threat would be tribunal, not ACAS.

I wouldn’t expect to get paid if I quid a job after a day. I’d just take the hit and accept it wasn’t meant to be and move on rather than chase the small amount of money

justflewinfromthewindycity · 30/08/2024 14:15

@Mumoftwo2022 £100 to me isn't a small amount of money

justflewinfromthewindycity · 30/08/2024 07:55

@Xiaoxiong it's just the principle of it all
They are so shady as a company with the no breaks etc and lack of hours between shifts etc
Plus I need the money as now I have no job
They had my details for two weeks before I started and was on the payroll app but now I'm not

You shouldn't have walked out then

justflewinfromthewindycity · 30/08/2024 14:29

@Janedoe82 maybe read the reason I walked out before chatting rubbish

What’s the break/shift thing?

justflewinfromthewindycity · 30/08/2024 15:05

@DeclutteringNewbie I was on reception,I was told I couldn't leave reception so meant I had no breaks /couldn't have lunch
Had to try and sneak a toilet break in
Finishing at 11 pm some nights and back in for 7 am
Having to go in to work Sundays even if I was off to find following week shifys

Was this a hotel?

Hungrycaterpillarsmummy · 30/08/2024 17:35

You definitely have to be paid for work you did.

It can't have been worth much to you if you decided it was worth more to quit and receive no salary.

whyNotaNice · 30/08/2024 17:38

Don't do this again. Go to a job where at least you know their HR details and can find them somehow. And don't just leave. Give it your very best and leave if it is really bad

justflewinfromthewindycity · 30/08/2024 19:39

@DeclutteringNewbie yeah a hotel

How did all this happen if you only worked one day? Confused

Whilst I agree about the breaks and stuff, the finishing at 11pm and back in at 7am is very normal for hotel receptionist roles. Were you not told the hours before you started?
