Ripped off WiFi where can I go from here

I was sold wifi at a speed of 20mbps for £30 a month. If I don’t return their hub which I can’t, they will charge me £75.
is this enforceable? what will happen if I don’t pay? I don’t want to pay because they ripped me off in the first place selling me a rubbish WiFi For £30 a month

it’s irrelevant as to why I can’t return the hub because it won’t change the fact that I can’t return the hub.
I have just told you they sold me a speed of 20mbps.

You sure it wasn’t up to 20mps? No provider gives an absolute number.

This! You will have signed a contract and it will be hard to prove uou didn't get the speeds advertised. So you need to return the hub or pay the charge

I assume you signed up to the contract and had access to the terms before you did, which undoubtedly included the hub non-return fee, the speed and the price.

In some areas, £30 for 20mbps is reasonable. It’s on you to do the diligence as to whether you’re willing to pay it or not.

As for what they can do, they can take you to small claims court and have a CCJ awarded against you which will severely impact your credit rating for 6 years.

Under ofcom guidance your provider should give you a minimum guaranteed speed. The days of advertising “up to” are long gone.

But I think OP is aggrieved at £30 for an advertised speed of 20mbps, as 20mbps is relatively low by today’s standards.

What does the contract say?
If it is part of cancellation that you return the hub and you can't then yes, they're going to charge you.

The return of the hub will be contractual, it remains their property during usage, so yes if you don't return it for whatever reason you can and will be charged.

If you've an issue with your broadband speed that's a separate issue that has nothing to do with the hub. Have you previously contacted them about what speed you're getting? What does it actually say re: guaranteed minimum speeds in your contract. If you can prove you've not received what you payed for then you can refer it to the ombudsman or their customer services - but it doesn't make the slightest bit of difference to the fact the hub is their property and you need to return it or pay the fee if you can't do that.

Yes it is enforceable. I assume they will add the debt to your account and debit you for it, then pursue it if you don't pay it, subsequently damaging your credit rating.

Two separate issues ….. After sending you loads of reminders, they will simply take the charge for non return of the router from your payment method as you will have signed a contract saying they can - it’s in there trust me.

Mis sold broadband as provider can’t achieve advertised speed- you have to inform them that this is the case. They have 30 days to rectify it. It really isn't. You're saying they're breaching the contract you had with them and therefore should release you from the contract without charge. They're saying part of that contract is for you to return the hub (we have the same clause in our WiFi contract). Stalemate.

I see people all the time selling their hubs / sky/ bt tv boxes and always think they’ll regret that if asked for them back.

Yes: if you cancel the contract and don’t return the hub, you have to pay for it.

Why is your broadband speed so slow? Are you in an area with poor infrastructure?

What speed are you currently getting? Have you done a speed test?

Just to clarify as well, you are not getting 20 megaBITS per second, rather than 20 megabytes?

Also to note, was it up to 20 mbps, rather than a guaranteed 20 mbps. I believe there may be a minimum guaranteed speed, but they won't guarantee the maximum 100% of the time.

And unfamiliar with the exact wording of the contract, but is your guaranteed wifi speed different to a wired connection. While the majority of users will be using their wifi router for wifi, a wired connection is more likely to be reaching the max speeds advertised.

There will be reasons why you cannot get the speed - if they have assumed perhaps you have fibre to the cabinet, and your road's cabinet does not, that may explain it.

Your devices to a lesser extent may have an impact - you could have fantastic broadband that will pants if the wifi card in your device just isn't up there. Unlikely to factor at 20mbps though as far as know.

I'm fairly sure you can cancel the contract if you are not getting the guaranteed minimum, but you will still need to return the hub. Why can't you return it - if you've broken it - of course they can charge you - its technically their property. If its that you've thrown out the packaging, just explain, and say you will pack it in what you have. If its that you can't be arsed, well think of the £75 charge as a convenience fee for not having to bother with packing it up.
