Has anyone registered as British by being born here as an adult?

Hello,

I hope you are well and.

I may , as a last resort , need and be forced to register as British by birth in the UK as an adult, as I was born in the UK and lived here my whoke life.
This is as I have no contact with my mum to prove her status at the time of my birth in the UK.

Has anyone done this?

What evidence is required?

Any advice is greatly appreciated.

Thank you in advance

TheSquareMile,

My immigration advisor is an old retired solicitor. He has contacts with an immigration specialist of over 25years experience. I will be seeing her in the new year. However, they are incredibly, yet understandably expensive

I would approach a firm with a track record in Immigration.

Case funding is sometimes available for Immigration cases.

I would contact a firm such as Duncan Lewis, who would be able to advise on your case and on whether there is scope for funding.

Hello again,

I have had a 30 minute consultation with an immigration solicitor this afternoon, and he said there are policies in place whereby an applicant has no contact with an EU parent to prove unavailable documents for the treaty of rights part. This is the only part I have a problem with, as I cannot prove she worked. I was wondering if anyone knows about policies hmpo has whereby parents documents not available as no contact with parents?

I am working on the settled status she had as a sponsor for my father , as his immigration history records have been requested.

Thank you all so much already for your help and advice. I really appreciate it.

Apologies if I have missed this fact, OP, but has your father passed away?

Zssn · 28/12/2023 22:27

TheSquareMile,

No, my father has not.

Thank you for clarifying that.

I asked because you had mentioned applying to the Home Office for his immigration records. Is this something that he has done in his own right and that it is he who is waiting for the paperwork to be sent to him by the Home Office?

Zssn · 28/12/2023 22:58

TheSquareMile,

My father has written an authorisation letter, explaining my situation to them for his entire history to be sent to me his daughter. Just identification was required from he and I.
Bless him, he always is more helpful to me than I ever could be to him.

Hello all,

Happy New year.

I have got all proof of residence in the UK for my whole life.

I was just wondering, if anyone knows when you register British from birth, do you need to do the UK life test ?
I would ring up UKVI, but as I am still working on proving my parents ILR before my birth, and with it being the weekend, I just want to keep my options open just in case.

I can't seem to locate this piece of information online at all. Maybe my eyes are fried from this entire situation of mine.

Thank you in advance.

No, you do not. When you register as British from birth, you are registering for a citizenship which you already possess. That is different to naturalising, which does require the KOL.

Zssn · 06/01/2024 21:35

gwenneh,

Thank you so much.

I’m glad you are making some progress.
DWP should also be able to find your mother’s work record here via her NI number and national insurance contributions she would have paid while working in U.K.

Zssn · 06/01/2024 23:57

Aydel,

Thank you so much. Slowly but surely.

Unfortunately, the DWP are not allowed to give my immigration lawyer, nor I , her work history details due to GDPR rules of identity and security. They said it is her details and no one can access it unless it is a judge that authorises it or she does.

They realised that she was under no immigration restrictions thus was settled, as she sponsored my commonwealth father at the time.

I have written to the IEC , and my MP is working on this too.

This is a great lesson for me to practice patience
