If I don't pay my rent will I be evicted?

spookyboooo · 24/09/2023 20:52

I'm In a housing association flat upstairs.
I posted a thread the other day so I won't repeat everything but the h/a haven't maintained the land next to my flat and a tree has grown over the fence and is now fully resting on my roof.
Damaging it and it's causing unbearable noise so I can't sleep.
I've been prescribed sleeping tablets and anti depressants from the GP to try and let me sleep through it but it's not a permanent solution as they've only gave me two weeks sleeping tables and I really don't want to take anti depressants as my only issue is not sleeping due to noise.
As I said in my other thread I've complained and they've said they have 18 months to get this tree cut off my roof-so now I'm waiting till I can do stage 2 complaint then housing ombudsman (which can take months )
My local counsellor hasn't replied to me and I have nowhere else to turn too
Tonight it's blowing a Gale here and I can hear the tiles smashing around -horrific noise again.
I'm so down
If I don't pay my rent what will happen?
How can they charge me rent to live like this

If you don't pay rent you will be evicted

TGGreen · 24/09/2023 20:58

No one will ever advise withholding rent, you will be evicted. Can you afford to get it trimmed? It seems madness allowing it to destroy your sanity (and roof) when the solution is so simple.

spookyboooo · 24/09/2023 20:58

I'm just at my end of tether with it
I just want the tree off my roof
I'm terrified it's going to do serious damage the next time it's a storm
I don't understand why they won't just cut it
It's their fault it's over grown like this

@TGGreen I have looked at private last week
They told me they needed written permission from h/a
The h/a said only their contractors can touch it
So private isn't a option

Can you post on a local social media group for someone with a chainsaw or gardening experience to come and help you? If it's over your boundary you are legally allowed to cut any overhanging branches

spookyboooo · 24/09/2023 21:02

The h/a have said I'm not allowed plus it's covering the full roof now not just a branch here and there -so it's a big job

Well the HA I have worked for recently wouldn't evict you immediately, they tended to let arrears build up quite a bit before taking action but it's not something I'd advise really. I would keep complaining.

BMW6 · 24/09/2023 21:09

Contact your local MP? Newspaper?

themez · 24/09/2023 21:10

Don't withhold rent. Escalate it as a complaint. Ring every day, take photos, make a big fuss. I worked for a HA for decades. Those who kicked off the loudest got heard.

kitsuneghost · 24/09/2023 21:11

Just hire someone to sort it out if it is affecting your MH

Doggymummar · 24/09/2023 21:14

Unless it's protected what are they going to do if you sort it out? I would go to the press with a sad FACE story I bet they fix it then

Irridescantshimmmer · 24/09/2023 21:17

Newspaper is a good idea, it will result in negative publicity for the HA which may result in them pulling their weight and doing something about it.

LIZS · 24/09/2023 21:18

Potentially yes. You could try the council housing office, shelter or cab for advice.

AnxiousPangolin · 24/09/2023 21:24

I’m not sure why you’ve started another thread on this. You’ve been given a lot of advice on your other thread.

Unless you want to pay for the tree work yourself and risk action being taken against you by your HA, you can only wait until the HA cut the tree back. Despite what people on MN say, you can’t just get some random with a chainsaw to climb a ladder and hack away at it then slip him £50. There is a reason why tree work is specialised and costs money.

Without wanting to sound mean, you have worked yourself up over this so that every time there’s a breath of wind, you decided you’re going to have a sleepless night and then you start posting desperate updates on here. It’s just branches brushing the roof, it’s not a tornado.

For what it’s worth, I do have some sympathy for you, but you need to find a way to live with it until the tree work is done. I suggested white noise and sea or rain tracks before and you said this helped a bit.

crowsfeet57 · 24/09/2023 21:26

The HA I worked for acted pretty quickly when an MP got involved.

AnxiousPangolin · 24/09/2023 21:26

And yes, of course you will be evicted if you don’t pay your rent.

ThisOldThang · 24/09/2023 21:32

These provide awesome sound isolation and I doubt you'd hear a thing. They're nice and soft and by far the most comfortable ear plugs I've ever used.

https://www.amazon.co.uk/Hearos-Ultimate-Softness-Plugs-Pair/dp/B000R8Y1Y6

You need to roll them thin and insert them deep into the ear. They then expand and form an airtight seal.

My only concern when wearing them is that they're too good and I probably wouldn't hear a smoke alarm.

Thatladdo · 24/09/2023 21:34

This is terrible advice but i would buy a balaclava and a saw.....

gogomoto · 24/09/2023 21:35

Contact your mp

caringcarer · 24/09/2023 21:41

If you don't pay your rent you will probably get warnings then be evicted. I'd be asking a tree surgeon to come over and sort it out. The HA probably won't even know you did it. Unless the tree is protected they really won't care. With the winter to come I'd get it looked at now. Anything is better than risking your MH over if you don't think you can wait 18 months.

ArtG · 24/09/2023 21:45

The housing department of your local authority can force landlords to effect repairs. Might be worth ringing them.

Crazycatlady83 · 24/09/2023 21:47

spookyboooo · 24/09/2023 21:02

The h/a have said I'm not allowed plus it's covering the full roof now not just a branch here and there -so it's a big job

What do you think the H/A will do to you if you hire a tree surgeon to sort out the problem OP?

Changingplace · 24/09/2023 21:48

If your local councillor hadn’t helped could you try your local MPs office? They have a duty to reply to constituents within a certain amount of time.

Stomacharmeleon · 24/09/2023 21:55

M.P. Sad face in paper.... name and shame.
Phone then everyday!

jazzhands84 · 24/09/2023 21:55

If the tiles are being dislodged there's only so long before you'll have water coming through the ceiling this winter. Now this is not something I'm recommending but perhaps if a bowl of water were to fall on the carpet, you might assume this is water from said roof and call the HA needing an emergency repair. When their tilers arrive, you can say oops, so sorry, silly me but let's move that tree shall we?
