BBC story

He's claiming sex discrimination. So many people have said that this appointment should have been exempt from the Equalities Act, I wonder if he'll succeed?

He's also claiming he was sacked, whereas the statements so far have been that the post was being removed, which isn't the same thing.

It sounds like his departure will be just as much of a dog's breakfast as his arrival. I hope he doesn't win.

It's a joke. If he wins his case it's hardly going to come out of the pockets of the people who gave him the job, or who sacked him/removed the post. It will come from the council tax payers of Tayside who pay for everything. The council is run for the benefit of the people working for the council, particularly those in upper management. Just like all councils.

It was a ridiculous appointment, but having made that appointment, the manner of his departure is ridiculous too. I don't blame him, presumably be gave up another post to take up this position.

He may win if proper process want followed in dismissing him.
However I wonder if his employers are aware of how he seems to have got the job? Maybe they could counter sue for having been a shoe in by his friend.

Well if it goes to court hopefully the alleged threats and abuse will be made public, which they should be. Lets be clear about what we're talking about and where they came from.

However considering if it goes to court there will be a few sticky issues to process, the chances would seem fairly good of him getting a good out of court settlement.

I suspect that's the way it will go. There are so many question marks around the whole thing, from beginning to end, the authority/authorities will just want it to go away as quietly as possible and with as little scrutiny as possible.

I think he should win. No, he shouldn't have got the job (and hopefully his claim will force the FOI request to be completed) but he's right. Due process does not appear to have been followed and it is sex discrimination. The job has been cancelled because of the backlash and the backlash was because he was a man. If it had been a woman there wouldn't have been a backlash and the job would (presumably) have continued.

The council should have used the EA provision at the hiring stage - if they had there would be no claim now. They should pay for their stupidity and utter disregard for women.

If what's being said is true he doesn't need to worry about his career and future prospects, his mate will find him another job pronto.

However if the proper process wasn't followed then it's fair that he should claim compensation, however he got the job. What I don't want him to do is win the discrimination part of the action. From the same solicitor: If Jason was not a man, would he have been dismissed from the role?

That's going to be very difficult to prove. If a woman had been appointed there wouldn't have been the outcry and abuse (does anyone know what the abuse was) that there was about his appointment. And again, was he dismissed? Or was the role withdrawn? If it was decided to do away with the post, discrimination would appear not to be involved.

I don’t think it was “ abuse “ so much as WTF & laughter from many, many women including Judy Murray & Martina Navratilova.

if he had been a nurse then possibly, just possibly women won’t have minded quite so much, but he is a personal trainer & he got the job by dubious means. Add the fact that the post was only advertised for a very short time means the whole thing stinks and it’s not going to go away.

For some types of employment tribunal claim you don't need any length of service - so for example he could submit a claim of wrongful dismissal or discrimination.
