DH facing driving ban due to speeding- any ideas on wait times?

Xtraincome · 24/06/2022 13:55

Hoping someone can help who has experience as I am struggling to find answer online.

DH will accrue 12 points on licence due to speeding. I am fuming as we are moving house- that's a separate thread for another time.

The letter was issued yesterday about his speeding, how long from now until they can take his driving licence off him? Roughly?

Any help is greatly appreciated 🙏

No idea on timescales, sorry, but I do know about insurance (and so should you and your DH). You must answer all questions truthfully at the time of application, and update the insurance company if anything changes, such as additional points or a ban. If you don't your insurance would be void in the event of a claim (and you could get charged for driving without insurance, and insurance feaud if you attempted to claim). Don't think they will never check or find out, because they do and they will.
When our cars were stolen the insurance company checked the licence details for all insured drivers on the vehicles with the DVLA. I know companies may not check for more minor things, but why break the law and take the risk? The DVLA will have anything licence related, like a ban, on record. He will have to suck up the cost, and stop driving like a fool.

Please speak with Andrew @ www.counsel.direct. If anyone can help your DH avoid a ban it’s him.

Why should he avoid a van? Or anyone driving like a twat for that matter?

That should of course say BAN, not van. Stupid autocorrect

On a practice side OP how far does your dp travel in a car each day, would looking at alternative means of travel be helpful? Electric bike might be an option?

wonderstuff · 25/06/2022 12:23

You sound absolutely lovely op, supportive and practical. Sounds like this might be a turning point, which of course would be the best outcome. Good luck.

Xtraincome · 25/06/2022 13:46

Thank you @wonderstuff for your kind words.

I knew i would be berated for staying with him on MN. But my patience is thin and I mean it, and he knows it! He is much brighter this morning and he feels ready to just let his license go. He is researching his new route to work as well.

@ivykaty44 I have heard good things about e-bikes. Will have DH look into it. Thank you

Maybe he shouldn’t but everyone should be entitled to the best legal representation they can get regardless of whether they’ve committed murder or a minor traffic offence. Part of that job is minimise the punishment. Look at Katie Price, she should be in prison but I’ll wager that she’s not, in part, due to her legal team. Regardless of my opinion, I’m pleased I live in a country where she’s entitled to that and the OP’s DH is no different. I wonder how many of you would advise a separated women to engage a shit hot lawyer for her divorce? Of course you would, you use and expert where required to get the best possible result.

When my husband lost his license for 6 months a long time ago , I phoned for insurance after he had it back and they asked me what convictions his points were for but we couldn’t remember them all so I phoned the DVLA to ask them to check .
They asked why I needed to know so I explained about the insurance . I was told not to tell the insurance about the ban as they won’t be able to check up on you anyway . DVLA won’t give personal information out to insurance companies.

riesenrad · 25/06/2022 15:06

I sincerely hope that they do take his licence off him. I am not sanctimonious about speeding because we all do it (yes even the MNers who claim they don't). But once you have 6 points on your licence you should start being a lot more careful and I do get sanctimonious about people who know they are on a sticky wicket and still drive like idiots.

I also think that if a court decides not to ban someone because they have special circumstances, they should only be able to use the car for those special circumstances and nothing else (eg taking sick mother to hospital appointments, but not kids to hobbies). I know it's not very enforceable but part of it could also be that at the end of the period that you would have been banned for, you still have to retake your test. And if you fail and/or you were caught using the car when you shouldn't have been, it's game over.

DVLA give out personal information to parking companies, I am sure they'll give info out to insurance companies!

Somebody lied to you.

No he doesn't speed with the kids in the car thankfully. He doesn't even speed with just me in the car since I bollocked him when we had our first DD.

He only puts other people and their kids at risk then. As if that's better.

wellhelloitsme · 25/06/2022 15:21

CarlCarlson · 24/06/2022 20:03

There’s some absolute clean shirts on here being precious - in reality it’s a few speeding tickets. Not a big deal, but his insurance is going to be pricey

With 12 points?

As someone who nearly died and has lifelong injuries as a result of someone's dangerous driving, don't be so fucking ridiculous.

wellhelloitsme · 25/06/2022 15:26

To be clear, my 'don't be so fucking ridiculous' was in response to @CarlCarlson calling posters precious for thinking OP's husband should get a ban and that he's putting lives at risk.

wonderstuff · 25/06/2022 15:29

@winnieanddaisy you can look up driving offences online with license number and NI number, I’m sure that DVLA share with insurance companies, consequences of lying on insurance application are severe and could result in you being uninsured at point of claim and insurance companies refusing you insurance, it’s really not worth the risk.

Actually, no, I wouldn't advise a separated woman to engage a 'shit hot lawyer'. Then again, I'd never be heard saying the words 'shit hot' in general 🙄 one day the equally dangerous Katie Price will indeed kill somebody with her dangerous driving, then we can all agree she should have been dealt with better much sooner. As someone who knows several people with very changed lives due to dangerous driving, it isn't something I take lightly.

Xtraincome You may find it saves you an incredible amount of money. No car tax, insurance ( you can get free insurance through BRitish cycling and Some household policies) no fuel costs or parking charges
