Hello All,

My friend asked me to ask on her behalf if anyone can help her, please

She is trying to find the information she needs for something that has happened in the shop.

She couldn't find it on Google or YouTube. The shop is hiding this information from her and is not giving it to her.

I think the member of staff needs to speak to their union, or perhaps ACAS can help, or Citizen's advice? We can't help as the story is laid out confusingly and no one can grasp all the issues.

Everyone has his/her own writing style and ways of communication.

And YOURS is crap and confusingly and inarticulate and NOBODY actually UNDERSTANDS you. If you want ADVICE you need to be really clear about what has happened.

Summary:

Premixed cocktail drink in a shop was expired so manager decided to give it away free.

Store assistant didn't look at what they were giving away free and gave it to an adult customer.

Adult customer didn't look at what they had been given free and let their 12 yr old drink it.

Customer realised 12 yr old had drank alcohol and made a complaint.

Store assistant is now going through investigation meeting next week to decide if disciplinary action will be taken.

OP is somehow related to Store Assistant and is trying to find legislation that proves manager shouldn't have been giving away free alcohol, and prove that manager was 100% at fault for the 12 yr old having access to alcohol.

Reality:

  • Yes everyone should have been aware that the freebie was alcoholic, blame is split 3 ways. Manager for not making it clear, store assistant for not looking at what they were giving away and customer for not looking at what they had been given.

All three at fault. Alcoholic drinks are clearly marked as such on the can.

if he has been dismissed it depends on length of service etc whether or not he has a claim at all but I wouldn’t think it would be worth taking it to a tribunal.

Surely the customer's responsibility not to give it to her son. All the stuff about it being free is a red herring.
