Bank has taken my UC payment!

I'm completely fucked. I bank with Tesco and have had a £1000 overdraft for about a year. I'm always overdrawn and am working to crawl out of it. UC paid my monthly payment in today, it was a slightly higher one if £1020 so took me out of overdraft. Within 1 hour fucking Tesco cancelled my overdraft so I have £20. £20 fucking pounds for the month. I have 2 dc and have no food, no rent money no pack lunch, no gas electric, fuck! Do I have any protection from this at all? I'm on the bus home now and will call them as soon as I get home I'm shy to do it on the bus, will they put it back? Absolute fuckers!

It's not a begging thread, Im asking for advice on how to get the overdraft put back, not for money.

Did they warn you in advance about the overdraft being withdrawn?

Fedupandpoor · 29/02/2020 18:09

Paid in yesterday, sorry having a panic Angry

No idea but bumping for you. They actually did similar to a friend stating that they were cancelling their overdraft directly before their salary was due...

Fedupandpoor · 29/02/2020 18:11

I had a letter saying I'm always in overdraft and they MAY have to withdraw it in the future. Not an exact date when it would happen. They could have cancelled it and then told me to make arrangements to repay it. Not fucking take it as soon as a payment goes in.

Thanks
Fedupandpoor · 29/02/2020 18:13

I could have told UC to put in a different bank if I had prior warning! They literally swallowed it up as soon as it went in.

TheSevenDials · 29/02/2020 18:13

Hope you get it sorted op.

Thisismytimetoshine · 29/02/2020 18:14

God, it’s hugely bad luck but I doubt they’ve acted illegally?

EvilPea · 29/02/2020 18:15

NatWest did this to me. It was horrific, no notice what so ever and I didn’t have kids at the time. It is utterly crap Flowers. Mine closed the account, so I would advise you to open another ASAP and get everything swapped over. I got a very basic nationwide account.
I believe there is a change now where they cannot put you into hardship. But you’d need to speak to CAB or someone. These things always turn up late Friday or Saturday when there’s fuck all you can do but panic.

Another thing I’ve heard vaguely about is hardship loans that are meant to help tide you over. Have a google, i think they were from the council, but it may be a universal credit thing now.

Again, I am so sorry. They shouldn’t be allowed to do it. I complained but got no where.

dementedpixie · 29/02/2020 18:15

I would definitely complain. Moneysavingexpert says:

One reason that an overdraft isn’t safe for long-term borrowing is that it’s not guaranteed.

The bank could withdraw it at any time and leave you without the cash you thought you had access to.

However, if your bank cancels your overdraft with no warning and you incur charges as a result, you might have grounds to complain.

If you complain to your bank and you aren’t satisfied with the outcome, you can take your complaint to the Financial Ombudsman Service.

AhoyMrBeaver · 29/02/2020 18:15

Ring your branch and make an appointment with a manager. That's probably the best way to negotiate having the overdraft reinstated.

ConsiderTheCentre · 29/02/2020 18:15

Banks can withdraw an overdraft at any time.

A friend of mine had the same thing happen with NatWest, after a long phone call call and chasing around, explaining the financial hardship it would cause it was agreed that the overdraft would be reduced by £100 a month, over 10 months. So going from £1,000 for march, £900 for April etc etc.

Chocolatecake12 · 29/02/2020 18:16

Oh my goodness that’s awful. I have no advice but good luck trying to sort it out

Ponoka7 · 29/02/2020 18:16

If they don't sort this out, perhaps you could get proof of it all and get a lian from the DWP?

You will certainly be entitled to food bank use.

Fedupandpoor · 29/02/2020 18:16

Tesco Bank don't have branches. I'm fucked 😔

OP posts:
JasonBrun · 29/02/2020 18:17

Wow I'm so sorry (fuck you Tesco). Have you spoken to them at all? Maybe see if you can get them to agree to a repayment plan rather than all at once?

Skierrdery · 29/02/2020 18:17

Oh, that was sly of them. They waited for a payment to go in then cancelled it. All you can do maybe is to see if they'll reinstate the overdraft.
If they won't, get referred to a Food Bank for starters. And ring your landlord and ask for arrangements to be in place for you to miss this month.

PurpleDaisies · 29/02/2020 18:17

There are some links on this site about the standards banks have to adhere to and how to complain if you think you’ve been treated unfairly...

dementedpixie · 29/02/2020 18:17

Ring them, complain and go to the Ombudsman as they have put you into financial hardship

Fedupandpoor · 29/02/2020 18:17

Food banks yes, but gas, electric, all that shit? Thank god I don't have a birthday or Christmas coming up. I am almost home so will call and update shortly.

OP posts:
BaronessBomburst · 29/02/2020 18:19

It's illegal for a bank to use benefit money to pay bank fees. If your overdraft included bank fees they've definitely cocked up.
Not sure how it stands with the rest of the overdraft though.

Dulcedelecherocks · 29/02/2020 18:19

Im sorry, it sucks. But it's on the T&C of all overdrafts that you need to pay it off every month or it might be overdrawn. That's why they wrote to you, and unfortunately they are entitled to do that. I work in a bank and had this happen to my best friend, and there was nothing I could do to help her.
It is however worth you contacting them and seeing if they will agree to decrease it slowly rather than all at once. So for example, £200 we month over 5 months. Good luck.

Knockalockin · 29/02/2020 18:20

I had this happen with a different bank.
They have a duty not to put you in financial difficulty. So if they can't reinstate it permanently, they can reinstate it and reduce it by a small affordable amount each month.

They might want to go through a budget planner with you too to see how much they can reduce it by monthly.

In the end they did a review of the decision and just put mine back on.

AhoyMrBeaver · 29/02/2020 18:21

Oh sorry, missed it was Tesco. Phone call asap then. They'll need to come to a fair agreement with you.
