Speed Camera but I wasn't there and neither was my car..

I ve had a request for driver information as my car was caught doing 24mph in a 20 zone.
The thing is I wasnt in that city on that day. I was in another part of the city the day before
There are no contract details and the form which I have to fill in has 3 boxes one if I'm the driver
One if someone else was
One if I no longer own the car

I am the owner but i wasn't there
What can i do other than a cover letter

Can you request the image? And do you have evidence of you and the car being somewhere else to contest it?

sometimes plates are cloned. you need to collect proof of you and your car being elsewhere - and it needs to be very solid as obviously everyone would claim this if they could. think about your exact movements that day and see if you can get cctv footage or other evidence.

Is there not a part that says if you don't know who the driver is, explain on a separate sheet why not. Can you not just write a letter explaining where your car was at the relevant time?

If you have an iPhone and have your significant locations switched on, you could prove you were elsewhere if you have no other way of doing so.

I keep my significant locations switched on for these kind of reasons because I'm a worry wart.

Is there a possibility anyone else was driving the car? If not you could say you were driving but dispute that you committed an offence.

This happened to a colleague at work.

His plates had been cloned.

Luckily we had site logs and CCTV to say both him and his car had been at our office, not where he was accused of being.

Have you got any evidence? Were you at work - did you have to swipe in? Were you shopping? Receipts etc. Can a person of good standing vouch for you?

I had this once - it said I’d been speeding in Luton and included a notice of intended prosecution for leaving the scene of an accident there. I’ve never been to Luton in my life!

I rang the local police who said it all had to be dealt with on paper, so I wrote a letter saying I wasn’t there and neither was my car. I didn’t hear anything for ages - even though I’d specifically requested an acknowledgement- so after a while I rang again and eventually managed to speak to someone who said it had all been a clerical error and that there wouldn’t be anything on my license or record. I never heard anything else. It was all a bit weird, and very worrying at the time. It was years ago now though and sure enough nothing ever came of it.

Frustrating as it is, if there’s no number I think all you can do is write to them, and hope it’s just a mistake.

What do you get if you google speeding tickets contact details in that area? You might find an email address or phone number.

This happened to DH too a few years ago. Fortunately he was able to provide proof that he wasn't at the place where the speed camera was, as he was attending a conference about 100 miles away and his car was logged into the car park there.

No real evidence
At the time of the offence I was at home the kids were asleep in bed and DH was away.
I think maybe requesting the image is the first step but I don't want the criminal conviction or £1000 fine for not sending the form back in time Shock

I had something like that happen (though I think it was a parking fine). Fortunately my boss was able to confirm that I'd been at work (and my car was fortunately parked outslde her office window every day) in a totally different part of the country on that date.

Definitely reply to the section 172 notice in time. Risk prosecution for that offence and possibly the speeding as well if you don't. It carries penalty points

I would write a separate letter with as much info as possible and return it with the form as soon as you can. You can request the image when you write the letter

Ring 101- mumsnet classic but they can do some camera work and it might be an easy fix. At least they can advise you on what to do next.

Talking professionally, you'll need to request picture (as others have mentioned) of the offence. There will more than likely be obvious differences between your vehicle and the clone veh. It may be as small as number plate screw placing or GB marker.
It could also be a genuine misread which is why it's also important to see the picture/evidence.
If your vehicle has been cloned, report it to the force where the offence took place. They can check ANPR for national readings to see if your registration is activating in different areas etc.

what does the letter you received look like?

if its a genuine letter from the police, it'll say 'Notice of Intended Prosecution' from your regional police force. even if it does say that, I'd still ring the main police office for your area and ask if they sent you one. if they did, you can then explain you weren't there.

there will also be a code and website on the back of the letter you can use to access your photo.
