Moving at short notice and hanging in notice to work

ODFOkaren · 01/01/2020 12:17

We have to move 200 miles away.

Unfortunately as we are at the mercy of landlords and estate agents, we aren’t going to have much notice.

We are going through referencing on a new place at the moment but it’s all been held up as the estate agent has been closed for two weeks over Xmas.

Dh is going up there tomorrow to see them in person, chase everything up etc.

Because it’s all up in the air I haven’t given notice at work. I’ve had rental properties fall through before and we can’t live where we are if I’m not working and living here we claim top up housing benefit which means that if I had given notice before now and was still living here while we were waiting to move or if it fell through it would have caused a lot of problems. (We won’t need any help when we do move as the rent is a quarter of the price where we are going).

I am supposed to give 4 weeks notice at work but we might get the go ahead tomorrow to move in two weeks.

Being so far away I can’t travel for work (it’s minimum wage care work, a weeks pay wouldn’t even cover the travel for one day).

I have no holiday let and I am off work sick this week and have been told I’ll be signed off for the next two (SSP as we don’t get sick pay where I work) as I’ve got pneumonia and other complications with it).

Hopefully will get a contract for the new house end of this week or beginning of next but I am loathe to hand in my notice before I have that in my hand just incase I leave my self unemployed.

I know I might have to take the hit and they can recoup their ‘costs’ by keeping my final Months pay - is this something they can do?

Bearing in mind one of the reasons we have to move so fast is that they messed up my holiday pay so badly that I missed one whole pay check in December - it’s forced our hands as we don’t want to default on rent and ruin a ten year perfect rent history and screw up our reference.

If you don't fulfill your contract terms they are unlikely to give you a reference.
Do you not need to give notice on your current property? Your post is a little confusing.
Personally I would explain the situation to my employer, they will probably appreciate the heads up and may agree to accept whatever notice you are able to give

ODFOkaren · 01/01/2020 12:34

Yes we need to give notice on current property but we will just pay them to end the contract if you see what I mean (that’s going to be a pain but because our outgoings will be slashed dramatically, we can borrow from a Family member and pay them back very quickly). We won’t be living here - we need to move away ASAP.

I won’t need a work reference from current job. When we move I will go back to being self employed, I can’t do that here as it proved a hinge problem with housing benefit.

I was taking about a landlord reference if we stay here and end up defaulting on rent.

As for giving work a heads up they are quite unreasonable and the organisation is a bit of a shambles.

If I were to give 4 weeks notice now and the rental falls through then I am unemployed meaning I can’t afford to live in current property and it’s a massive struggle with re sorting out benefits.

Dh has secured a work transfer. As soon as we get the new tenancy that will swing into place (his job are excellent and he’s the main earner). So I have that to consider too.

I’m trying to protect is really.

Your post is confusing, you have to move because your work didn't pay you in December, yet you don't want to hand your.notice in as you will be unemployed- will you not still be unemployed when you move?

SpudsAreLife84 · 01/01/2020 12:38

When does your annual leave year end? Most places run April- march with the financial year- if yours is the same you will owe them annual leave back

Todaythiscouldbe · 01/01/2020 12:39

If you don't need a work reference then do whatever you like. They can't legally not pay you for work you've completed, but as you're off sick that's irrelevant anyway. Don't give notice, just leave

ODFOkaren · 01/01/2020 12:39

Protect us.

So it goes like this to clarify -

Will possibly get contract next Monday.

We may be able to move in ten days.

Work notice is 4 weeks, I can’t work that being 200 miles away.

I can’t tell work I’m leaving until I have that rental contract in my hand to avoid making myself unemployed and unable to pay rent in current place if it falls through for some reason.

We have to give notice on current house but will negotiate with agent and landlord to pay it out so we will leave this property when we have the contract on the new place. Again, reluctant to hand in notice on this house as it’s near impossible to find anywhere willing to rent to us claiming top up HB even though we are both working (and again, this isn’t a problem where we are moving to as it’s so much cheaper).

I would talk to them first thing tomorrow because you might need a reference. Go to them with the opener that you're in a very difficult position and you don't know what to do and it's causing you a lot of stress as you're so conscientious.

They will want you to keep coming in for as long as you CAN and that's your goal too.

If it's a low wage job I cannot imagine that they're going to su you. I'm supposed to give 4 weeks notice but I know people have disappeared with a weeks' notice. Nothing has happened.

I'd be honest though. Job hunting with nobody you can give as a referee is very hard.

Todaythiscouldbe · 01/01/2020 12:40

Actually SpudsAreLife84 is correct, they can deduct owed holiday pay from final salary

ODFOkaren · 01/01/2020 12:40

I won’t have to work when we move - Dh warns enough to cover everything I. A place that isn’t London! But I will take up my self employed work again as I’ll have the freedom to do that without claiming top up housing benefit.

OP posts:
ODFOkaren · 01/01/2020 12:42

If I do decide to take another job I have referees from my previous self employed clients - that was how I got this job, I’d only been self employed or a sahm before.

Sh0na · 01/01/2020 12:42

If you gave provisional notice depending on whether or not the new opportunity came through or not, would they not let you come back if it fell through?

If that is the case then I'm thinking you shouldn't stress this much about them. They don't sound great.

I get now, you cannot tell them anything til Monday.

ODFOkaren · 01/01/2020 12:43

@Sh0na “I would talk to them first thing tomorrow because you might need a reference. Go to them with the opener that you're in a very difficult position and you don't know what to do and it's causing you a lot of stress as you're so conscientious. ”

I have don’t this repeatedly about my last pay check - the holiday pay they didn’t pay me. I’ve either been ignored so far.

OP posts:
ODFOkaren · 01/01/2020 12:47

Basically the situation is hopefully we will get the go ahead to move jan 10th. We’ll be gone that day.

But that’s only hopefully - we were in this situation before and the LL decided on other people at the last min because the wastage agent had wrongly assumed Something it was too late to change LL mind. If I’d already put in my notice that time I’d have been screwed.

OP posts:
FanSpamTastic · 01/01/2020 12:47

Does any of this help CAB?

Todaythiscouldbe · 01/01/2020 12:48

What is the actual question you want answered?

LIZS · 01/01/2020 12:50

If you partner has a job waiting presumably that has a start date. If you hand in notice you could move with him into whatever accommodation he has planned short term.

ODFOkaren · 01/01/2020 12:51

Can I leave without notice basically.

If I get the rental contract on Monday, I want to quit there and then.

OP posts:
ODFOkaren · 01/01/2020 12:52

@LIZSno he has no start date. His work are great, huge company. They won’t start the handover until we get a rental contract. He’ll have to work a couple of week down here while it goes through but he works remotely and only has to go into the office two days a week. So it’s just a b&b for one night a week until he changes location.

OP posts:
LIZS · 01/01/2020 12:53

Only by negotiation. If you are willing to forgo sick pay etc for that period for example. Or you use sick note for your notice period. You say you have to move 200 miles away but presumably not just for his work.

ElloBrian · 01/01/2020 13:00

So hang on a sec. You’re going to pay the rest of your contract on the current place? So why not just stay there while you work your notice? You’ll be paying rent on it anyway as part of your notice period on the property.

SoloMummy · 01/01/2020 13:00

Your situation seems more Complicated than it needs to be, but responding to the post. My best advice would be once you have the new contract etc resign stating the month's resignation date as your last working day.
Then I'd see if you can get an additional sicknote Covering until the end date.

Remember, if claiming benefits this will ve deemed as you having made yourself jobless if on hb or uc. So won't receive payments if children are older than 3. So would need to start self enoyed business pretty much immediately.

It's worth trying to keep the current employer onside to get a reference as if your self employment doesn't go to plan etc you may need a plan b.

SoloMummy · 01/01/2020 13:02

Technically work can pursue you for breach of contract.

ODFOkaren · 01/01/2020 13:04

@ElloBrian we have the complication of a year 12 changing college. We need to get up there ASAP as it’s bloody hard to change courses etc.

Plus when I spoke to the agent here she advised that it’s a much better tack with the LL for us to go ASAP so he can find new tennants. It’s all very complicated.

OP posts:
ODFOkaren · 01/01/2020 13:06

@SoloMummy when we move we won’t be claiming any benefits as we won’t need to/won’t be entitled to. We get a small top up of HB in London as rent prices are crazy.
