It is illegal to film someone on a beach without their consent?

Have NC. This is a weird one but it's bugging me.

I sometimes look at an instagram account that has around 120k followers. This person is a somewhat public figure albeit very minor.

They are currently on holiday and they have twice posted footage of fellow holidaymakers on the beach. The footage is obviously supposed to be mocking their appearance. The last one was a video of a middle aged man in tight swim shorts. The footage lasts maybe 10 seconds or so and was accompanied by a shocked/bemused emoji face.

Is this legal? It's such a horrid thing to do to someone. I'm baffled about the motivation behind it.

Anyone know if this is legal? TIA

There are often news reports on TV about obesity and they show loads of footage of people walking along the street, obviously unaware they're being filmed, usually focusing closely on one or two individuals up close, although without showing their faces. I often think that those people must get a terrible shock to see themselves on the news being used as an illustration of societal issues, it's sure to hurt a bit.

Celebelly · 20/07/2019 22:45

No reason you can't name them! They've posted it on their Instagram, it's not a secret and you aren't accusing them of anything they haven't done.

Bringonspring · 20/07/2019 22:46

Clue please, if they have an open profile I can’t see why you couldn’t

HariboHippo · 20/07/2019 22:46

Exactly that Imighthave, I normally look for the nice family pics, and the extravagant lifestyle as I do like to look at the wife too, but the posts have got very cruel of late. I do hope it is just “mates” having banter. It’s a story isn’t it not a post so there’s no comments to judge how it’s gone down with the followers unfortunately.

Imighthavegotthiswrong · 20/07/2019 22:48

Ok. It's Jay Rutland. Husband of Tamara Ecclestone. The footage is on his instagram stories

Cross post sorry!

Imighthavegotthiswrong · 20/07/2019 22:55

Haribo. I'm like you. I like looking at the beautiful places they visit. It's a bit of fun. Well. It was. This had put me right off. Win't be looking anymore.

I’ve seen it, it is cruel to record and laugh at someone. It’s not like the face was blurred or it was taken from a distance, it’s a close up video and he was laughing at that man, who could easily be identified.

I used to follow him but stopped a while back as he put up a video of himself arguing with another couple whilst in USA, I think they were in the queue for ice cream and for whatever reason an argument broke out. JR recorded it, he his camera phone in the other couples faces, and I just thought at the time no matter the rights or wrongs it was really disrespectful and humiliating, quite frankly I don’t care to see that, so I unfollowed.

Blubluboo · 20/07/2019 22:56

Just watched it. I completely agree with you! Why are people like this? Horrible.

Imighthavegotthiswrong · 20/07/2019 23:00

BarryBarry ah, i didn't see that footage about the argument. He obviously has form for this.
I don't actually follow him. Just look occasionally. Thought him and his wife seemed reasonably nice people despite the enormous wealth. I was obviously wrong.

Sometimes they crop up on explore as I must have friends who follow them, it is occasionally nice to wistfully look at their holidays pics, but I don’t particularly like him I must admit.

LaurieFairyCake · 20/07/2019 23:10

I don't see anything Confused

It is illegal to film someone on a beach without their consent?
BarryBarryTaylor · 20/07/2019 23:11

It’s on his stories laurie you have to tap his profile picture to watch it...if you want to!

Imighthavegotthiswrong · 20/07/2019 23:12

But looks like it's all legal so nothing to be done. If it is what it appears to be, it is SUCH a arsehole thing to do.

I really dislike that people can do this, to ridicule people without their knowledge is horrific and I feel goes away for human nature. Whether you’re fat / thin anything else, you shouldn’t be filmed without your knowledge, especially for other small minded people’s entertainment.
On a separate note, i don’t post me / my children online, neither do their schools / settings etc, why is it ok for another person to do this. Wrong on so many levels and says so much about this VERY privileged guy, not the one he’s filmed.

LoopySoo · 21/07/2019 00:51

@Imighthavegotthiswrong
Perfectly legal. I was filmed/had photos taken of me once when I was stood in a hotel car park wearing just a vest top and knickers after the fire alarm went off at night. Nothing I could do as it was in a public place

LemonTreeLemon · 21/07/2019 03:51

I don't think it's illegal but you should unfollow immediately. Don't encourage this behaviour.

If I was following someone behaving like this, I would also PM them and tell them what I thought of them! And then would unfollow them.

Hels20 · 21/07/2019 06:50

I also thought him videoing the man dancing was done in a mocking way. Why can’t people just have fun? Gosh - has really changed my opinion of the couple

Waffles80 · 21/07/2019 06:59

I remember that gym incident. Can't remember her name. Awful thing to do but don't think the filming is illegal. Not sure about the posting online bit for everyone to laugh at.

This is wrong. The person being filmed and ridiculed was in a changing room - this is not a public space. The idiot who posted it was found guilty of invading the woman’s privacy.

In the UK and the states privacy law is that an invasion of privacy has occurred if a person has a reasonable expectation of privacy.

Just shows how mean someone can be. Makes you think about their relationships too. People aren't mean in isolation, if they can be mean to someone then chances are they're mean to everyone at some point.

Imighthavegotthiswrong · 21/07/2019 07:47

Hels i don't think i saw a video of a man dancing. Shameful behaviour though.

For clarification, I dont follow him. Only look occasionally. Certainly won't be anymore.

It's not illegal but I think it is wrong. It has helped increase people with body issues I feel, and camera phones seem to have almost completely ended topless sunbathing.

Oblomov19 · 21/07/2019 08:55

Why are you following this person if they are so vile?

StealthNinjaMum · 21/07/2019 09:00

Op I don't think you should have named them, it'll send even more people over to look at the video o the person. You've helped invade this persons privacy even more.
