Can anyone advise how shit this will be?
Carphone warehouse refusing to exchange it return 🙄

I know its fine until august but after that the phone can't update and could not be secure? What exactly does that mean?
Should I not use mobile banking or shopping or work payments on it?
Will Google apps work?

Confused and annoyed.
Can anyone shed some light?

No idea how bad it will but when you say just got it, when exactly and was it in store or did you sign up for any part of it online?

NicoAndTheNiners · 26/05/2019 15:23

I think the issue will affect future phones. Google have said anyone who already has a phone will still be able to use the Play store and get security updates in the future.

hugoagogo · 26/05/2019 15:52

If you've signed a contract, won't there be a cooling off period anyway?
(I've never had a phone contract, so really no idea.)

marriedthegambler · 26/05/2019 16:08

I recently got a phone from Carphone Warehouse and there was a cooling off period for new contracts but not for upgrades. Mine was a new contract so I took it back and contract cancelled.

itsbetterthanabox · 26/05/2019 16:39

No cooling off as its vodaphone apparently

Vodafone don't have different consumer laws to everyone else, you either have a cooling off period or contain you don't.

When did you buy the phone, we've known about the updates possible problem for quite a few days now, can't remember exactly when but seems like at least a week.

OliviaBenson · 26/05/2019 16:45

I thought you had a 14 day cooling off period, no matter which provider? Do some research op!

itsbetterthanabox · 26/05/2019 16:48

I've done all the research they definitely won't let me return it. I bought it last Monday. Didn't know the issues and was told in store there was none.
I've been into store and argued it and called customer services. Nothing.
I more want to know info from techy people on how this will affect my phone use in future.

If it is a Vodafone contract that you bought from Carphone Warehouse you need to contact Vodafone and cancel under the terms of the cooling off period. I know because I’ve done it myself.

Here, from Vodafone website:

You can cancel your contract at any time over the phone. Use the ‘Give us a call’ button to find the most suitable number for you to use.

There’s no charge if you cancel within the first 30 days of your contract, or when your minimum term has ended. If you want to cancel any time in between, you’ll need to pay an early exit fee.

NoBaggyPants · 26/05/2019 16:54

Cancellation rights here:

selfhelp.carphonewarehouse.com/SelfHelp/request.do?view()=c{11a18a50-bcb7-11de-e56d-000000000000}

There's no statutory right to a cooling-off period when a contract is made in store, and unfortunately Vodafone do not offer one.

MuttsNutts · 26/05/2019 16:56

NoBaggyPants - Vodafone have a 30 day cooling off period. I’ve used it myself this year.

Remember the ads - “If you don’t love us you can leave us”?

NoBaggyPants · 26/05/2019 16:57

Vodafone's terms state that their cancellation policy does not apply to:

"Equipment ordered from another company (like Argos or Carphone Warehouse) - you’ll have to go back to them to find out what to do"

NoBaggyPants · 26/05/2019 16:58

@MuttsNutts The OP bought from a third party. The terms are clear on this.

www.vodafone.co.uk/terms-and-conditions/Business/buying-with-vodafone/buying-online/returns-policies/index.htm

MuttsNutts · 26/05/2019 16:59

I bought from Carphone Warehouse myself.

RibenaMonsoon · 26/05/2019 17:08

If its carphone that sold it to you, you will be bound by their return policy. Vodafone offer a 30 day cooling off period, but that's only if you've bought directly through them. Carphone don't have a cooling off period.
It has nothing to do with the network you are on, it's the retailer that sold it to you.

Honestly most of the information online about Huawei is pure clickbait. It won't change much at all. I have a Huawei, have for a while and I'm not worried. It's being made out to be a much bigger deal than it actually is. It won't affect the workings of your phone in terms of how its used and what you can access.

booksandcaffeine · 26/05/2019 17:12

From what I read, it'll only affect future phones. Existing users shouldn't be affected by this... Well I hope not as I'm a Huawei user too.

itsbetterthanabox · 26/05/2019 17:13

Just had another argument with customer services and raised a complaint.
They will not return or change it.
I really wanted to know more about how this is going to actually affect my use of the phone in the future.

MummyParanoia101 · 26/05/2019 17:13

I used to work for carphone @itsbetterthanabox and they have a 14 day network guarantee. Say you get no signal at home!!!!!!! They'll have to cancel it

Aspieteach · 26/05/2019 17:17

I've bought my Huawei outright and got a SIM only contract so I'm planning to hang on to the phone for years. I'm not worried. All the reports I've seen about the restrictions that the US government has made Google impose say that these only apply to future models.

BossyBanana · 26/05/2019 17:17

I’ve been in your position.

I told them I didn’t get a signal at home (drove around until I didn’t have a signal and took screen shots to ‘show’ them)
I was advised on the MSE website this was a guaranteed way to get it canceled and it worked.

Melioration · 26/05/2019 17:17

I also understood it was only future work between google and Huawei and not current phones. I bought one about 3weeks ago.

Graphista · 26/05/2019 17:31

"Didn't know the issues and was told in store there was none." Were you told this after the issues were known to THEM? If so they've missold the contract surely.

In which case this applies:

www.which.co.uk/consumer-rights/regulation/consumer-rights-act

As with the Sale of Goods Act, under the Consumer Rights Act all products must be of satisfactory quality, fit for purpose and as described.

But yes cooling off period applies regardless of who the contract is with or what the contract says. A contract cannot negate the law of the land.

Personally I think sale of huawei should have been suspended until the whole mess sorted and clarified.

RibenaMonsoon · 26/05/2019 19:17

A cooling off period is not the same thing as 'right to reject'.
You have 30 days to reject your goods if they are an unsatisfactory quality, unfit for purpose or not as described. It doesn't cover returning goods just because you've changed your mind.

You could definitely put the Huawei under the unsatisfactory and unfit for purpose umbrella if they aren't functioning as they should. But all current models are... Any future handsets Huawei make may unfortunately not be (Which the retailers will then have to make customers aware of this before purchase). But any current ones are fine, so how has anyone been misled here?
