PLEASE can someone with passport knowledge help with a really difficult situation?

When DC 1was born, I registered him in my surname, we have recently changed it to dad's surname, we did this at the registry office, so new birth certificate. There has been no problem with getting a provisional license, however, passport is another thing.
He has received an email from them stating that they want proof of change of name, they're talking about deed poll etc, and I just don't understand.
I've attached the email.

You need to send them the birth certificate for proof.

As far as i know, in the uk you cant get a new, ie changed birth certificate. So you should have the original plus a deed poll/however you changed his name certificate.

He was registered at birth at the registry office with your surname - 17 years ago?

You have recently been back to the registry office to register his fathers surname? and have a new birth certificate?

It looks like you just send one thing off the list. Does he have a job? Does he have official exam certificates or could you get school to confirm on headed paper if hes still at school?

I changed the spelling of my name recently and I had to send a statutory declaration form. I went to the solicitors who drew up the document & then I had to swear an oath in front of another solicitor.

With a change of surname, I suppose he'll need to do a name change by deed poll.

How did he do the name change? Statutory declaration, deed poll? What did you use at the registry office to get the name changed in the first place?

Do you have anything to prove he is actively using the new name?

If you change a baby's name when they are less than 12 months (I think?) then you can get the original birth certificate amended and reissued. Any changes made later must be done by a certified deed poll. Thereafter your child has two legal identification docs; the birth certificate and the deed poll document showing the amended name. You need to send both to get passports and similar but should then be able to use the passport as an ID doc when needed.

@tickingthebox, that is correct, altho he's 20 this year. The reason being, is because I was very young when I had him and thought it was best to keep him in my surname, however happily, his dad and I
are still together, and so decided he wanted to take his name in adult hood.

Iam, he has been given a new BC with his dad's surname which has been sent to the passport office.

Hmm, they're talking about a deed poll tho?

What did you use to get the name changed though. They wouldn't do it with no proof surely

Looks like they need a statutory declaration witnessed and one other proof of dc using their new surname. Passport phone line is actually pretty decent - you can call them and check.

Mine and his dad's BC's were used in the registry office. So do you think if a copy of the bc in original surname, and one in new surname are sent that will be enough? He is using his provisional as ID ATM

If so, his new birth certificate is enough, I don't think it should be treated as a deed poll or change of name.

Did you pay for the correction? The link says you need to apply and pay for a correction. I'm surprised they would do it just using birth certificates tbh

Surely if he was an adult wanting to change his name then he needed to do it by deed poll.

What corrections can be made

You can apply for a birth registration correction when the information is wrong - for example if a mistake was made when recording a parent’s occupation.

You cannot apply for a correction to show new information if circumstances change after you’ve registered your child’s birth, for example if you change your name after getting married again.

However, you can apply to re-register the birth if the natural parents get married at a later date.
