When DC 1was born, I registered him in my surname, we have recently changed it to dad's surname, we did this at the registry office, so new birth certificate. There has been no problem with getting a provisional license, however, passport is another thing.
He has received an email from them stating that they want proof of change of name, they're talking about deed poll etc, and I just don't understand.
I've attached the email.
TIA.

Are you now married to his father?

LittleBearPad · 07/01/2019 19:01

It wasn’t really a mistake though was it.

The letter gives the wording and then you get it signed by a solicitor. That's what your letter says anyway

IAmRubbishAtDIY · 07/01/2019 19:02

As far as I can see, his 'new' birth certificate is correct, as correct as mine or yours, he hasn't 'changed' his name at all.

Loopylou6 · 07/01/2019 19:02

Pixie, I have no reason to lie, honestly, that's all it took

However, you can apply to re-register the birth if the natural parents get married at a later date.

You've done this. You don't need a deed poll.

Thanks pixie Flowers

You will definitely need to chenge by deed poll. Not sure how long the process takes to go through the courts

dementedpixie · 07/01/2019 19:06

Although the wording in the letter doesn't make much sense

Emmerdaledramaqueen · 07/01/2019 19:06

If your in Scotland you don’t need deed poll. My son had same situation and only needed both birth certificates and a letter from school as proof of using new surname. Has had a renewal since with no issues.

dementedpixie · 07/01/2019 19:07

Just do the statutory declaration - it's just him stating he is giving up one name in favour of another

IAmRubbishAtDIY · 07/01/2019 19:08

No you don't need a deed poll, she registered him as a single parent/unmarried mother, then later married the father of the child, which means the child can have a new birth certificate at any time, the one year thing doesn't apply in this case.

I would sent your marriage certificate with a covering note explaining that you had a correction done to his birth certificate as you married a number of years after he was born.

When I applied for my first passport I sent my parents marriage certificate with a covering note explaining that my name had changed due to my parents getting married.

It might also help to do a statutory declaration, you can search for a Commissioner for Oaths in your area using Google or a Notary on the Notaries Society website. I've had to do one twice and my local one only charged £10 each time and it took 10 minutes.

Hi
My daughter changed her surname by deed poll aged 16.

She sent that and a college id card (to show she v was using the new name,) and got her passport in the new name.

Deed poll was free to do , just needed a couple of signatures eg Dr,priest, teacher, police etc

Geib8314 · 07/01/2019 22:28

She already had a passport in the old name though, so that might b make a difference

PerspicaciaTick · 07/01/2019 22:37

You can change your child's surname when re-registering their birth after marriage or to add the father's details provided the new surname meets guidelines.
The passport office should accept the new birth certificate.
You might want to call the General Register Office on 0300 123 1837 for a definitive answer.
