IF you were sentenced to a year in prison

And then fell into a coma on the day of your sentence and then woke up on the day of your release, would you still have to do the time? Or redo it? Or would they just let you go 🤔

I know nothing about the U.K. prison service is it like America where they give you a date to go to jail? I thought the U.K. you were on court and went straight to jail from there.

If so you would already be in custody and your sentence would have started so yes you would be serving your time.

Presumably you would have to stay in a secure medical facility (in case you woke up and absconded) so the secure facility would count as prison.

There are secure medical facilities in prisons. I’ve only ever visited one, but people were receiving all kinds of care including end of life care (cancer), dementia etc. I suppose it may depend what level of support your coma might require

The UK justice system so is fucked up they'd probably pay you compensation for not being conscious to receive your rehabilitation activities!

I have a friend in prison currently who had someone in the next... Cell? Block? Wing? Don't know the terminology - Go into a coma with a few weeks left on the sentence. Woke up and was free to go.

I wasn't in prison for eating before getting to the till or something Xmas Grin

It would be handy. I think it would have to count even if you spent the entire time in a normal hospital. The year is up. You wouldn't have been free to go if you had recovered during the year so you have done your time.

Definitely would count as time served. Given I don’t think there would be any loss of time served for bad behaviour you should get out around 6 months later when you would be transferred to A high dependency unit in regular hospital but at least your family could visit regularly until your wake date Smile
At criminal bar and have had clients with similar situations. Usually the other way around ie clearly diagnosed fatal illness meaning deathnlikely to be before release results in earlynrelease or shorter sentence imposed - not in all cases obvs - depends on type of offence, length of sentence, how much served and release situation etc.

If you overstayed you'd probably be charged for your accommodation. I'm almost certain that there was a strange case a few years ago where someone had been wrongly imprisoned and was awarded compensation. But then they were forced to hand some or all of the compensation back to the government to cover the cost of having imprisoned them in the first place.

Actually, there was probably a lot more to it than that, but it was one of those unbelievable sensationalist tabloid stories, so that's how it was reported.

Possibly cos that defendantnrepresented himself and told probabtion/court deliberate falsehoods to avoid eg wife becoming involved which also meant non custodial was ruled out as community sentence no longer appropriate ?? But in that case compensation would be unlikely in the first place. Hmmm thought provoking. Possibly he received benefit whist inside which was considered lasting - ie drug treatment, education , medical or dental treatment but still can’t see basis on which that would be recoverable by HMP.

Yes, it was definitely odd. I think it was probably some very complex case but the media just reported it as 'ooh, look, man was wrongly imprisoned and is now being charged for it'.

Treaclesoda I seem to remember something like that for the Guildford Four or Birmingham Six, but I don't know if it was ever actioned. Jack Straw involved possibly?

I read the book that OITNB was based on. In real life, Piper's actually had, as I recall, over a YEAR where she knew she was going to prison but didn't know where or when, due to hold ups with court etc. I don't have much sympathy for her, she committed a crime and deserved to go to prison. But that wait must have been terrible.
