Losing are car today because they fucked up PIP

I don't know what I'm looking for from this thread,help or maybe a miracle before the end of the day.

We have a motability car which my mobility part of my DLA paid for.I'd just been awarded DLA for the rest of my life and then low and behold they changed me to PIP.

The change was okay until I had to go for the assessment,I have no idea what went wrong but the lady doing the assessment got everything wrong,she put that I can walk a certain distance and climb stairs,I can't do either I've been in a wheelchair for nearly 10 years now,she stated that I can cook for myself and sort my own medication which is all wrong I have a rare form of brain damage,I'm not allowed to use the toaster and kettle let alone cook a meal and I can't have anything to do with my medication because the one time I did I managed to overdose by accident.

We have challenged the decision and to add insult to injury when my DH first spoke to them they told my DH that someone had forged the date of when they received the information from us(it had been forged they're end by 2 weeks which ment they'd have 2 weeks more than they should to sort it out)they promised to get it sorted out they're end,my DH rang them again 2 weeks later and he spoke to a manager and he also admitted that the date had been forged and that they would have it all sorted.

Well low and behold to get it through on the last day that they had to get it all sorted(by they're own rules)they've signed it all off as being fine(meaning we lose the car)were both at the end of our rope here(me and my DH)we need the car,it is a lifeline for all of us,we have 5DC and 3 of our DC go to school miles away from where we live(they were the only suitable schools because they're all asd)and the car is the only way I can get out,I can't go via bus because of my health(I can need to leave somewhere within a minute)so I'll be stuck in the house.

Were going to appeal,we had to do the same for our DS17(he was given nothing and the courts changed it all and he got his Pip back)but that will take months.

We don't know what to do?If anyone could offer any advice it would be amazing.

Sorry for any spelling mistakes,grammar mistakes ect,I have the braindamage to thank for that.

I think while you're asking for a mandatory reconsideration, Motability will let you keep the car...have you called them?

Re your children’s schools- if they have autism and their schools are named on their ehcp (if they have them) you should be eligible for school transport. My son goes to complex needs school 24 miles away and gets a council funded taxi and an escort. I would contact the council and ask.

Dhalandchips it's the mandatory reconsideration that they mucked up,they forged the date by 2 weeks on the paperwork because they'd had all of our paperwork for 2 weeks and hadn't even looked at it.

Although they're in the wrong the car place have said there's nothing they can do.

I'd call Motability again, or is that the 'car place' you've already tried.
I'm so angry for you.
I had this same situation hanging over my head in the spring but it went in my favour. I also have kids who wouldn't have been able to get to school, I wouldn't have been able to get to work. I'd have been housebound.

I have MS and I lost money when I was moved to PIP, and I too had my mandatory reconsideration refused. Eventually I lodged an appeal (I used fightback4justice to help me) and within two months I received all the backpay and the decision was overturned, without my having to go to court. So you may not have to wait too long.

I don't think they should be allowed to just pay back the money though, after all the distress we are put through. The assessors responsible for the original decision should be investigated and disciplined, and we should receive compensation on top of back pay.

I am hearing this 2 week thing a lot lately. I sent off my MR after being refused PIP with a report that sounded like it had been written about someone else it certainly wasn't me! I rung after 2 weeks only to find it had 'accidently' been filed and not actioned so like you a longer wait for a decision. A bit of googling and I found this is happening to a lot of people.

I agree with you,I said the same to my DH about the lady that we had seen because she asked me some questions and we answered them and she put down completely different answers and then there were questions we weren't even asked and yet they've been filled in?

We had the same happen with our DS's appeal as well,I'm such a idiot,looking back at that that is quite obviously fraud and I've not done anything about it,this is one of the reasons I hate being disabled so much my sodding brain damage has erased what was once a perfectly functioning brain.

I am so sorry this is happening.

The DWP's position in a lot of cases is to back up the ATOS or Capita's Face to Face Assessor's report as though it is The Word Of God when often it's observations by someone who has no idea about your conditions and their impact on your abilities.
Awful as the situation is, the onus is now on you to prove it's not, and to challenge every one of the statements which you say is wrong, the more evidence you have to support you, the better you can present your case.

Stop phoning DWP, make sure everything is in writing.
You currently have no record of who said what, if you write to them, you do.

e.g.
Heading with name address, NI number and their reference.
Dear Sir,
I refer to my telephone conversation with [name] on [date] in which the following was agreed [list of main points, don't waffle]

I would like [state what you want, update of current situation, explanation of their actions or whatever]

Yours Faithfully
[your name or your husband's if he is your appointee]

Keep a copy of all your letters and replies, note how long replies take. It will all help with your evidence for appeal.

You must appeal, I know it's very difficult to do, but you must stick at it and go to Tribunal. Make sure you get your appeal in within their fixed timescale.

Helpful evidence includes any medical reports, NHS wheelchair assessment, DLA indefinite award decision etc.

For now, I'd definitely get onto my local Councillor and MP, (maybe even the local press or even national) to explain the difficulty of getting your kids to school and ask them how the Council intend to do that for you now your transport has been removed. Flowers

So sorry OP, the PIP process is terrible, causes so much angst, especially considering under DLA your award was for life why can’t that be transferred, of course that would be too simple! Definitely get MP involved ASAP and I hope you get it resolved, it really makes me so cross. Sending you a hug.

Do you have access to a CAB or similar to help you with your appeal? That's what you need really. Yes your MP should be able to help with the two week problem - it is far too common and a known issue.

Nothing can be done about you keeping the car, it must go back unfortunately, you can only keep it during the MR stage (which took a lot of campaigning) but not the appeal stage as that can take a long time depending on where you are in the country, as the MR failed you're assumed to no longer qualify (I'm not saying you don't!).

Regarding the questions not being asked that's because of how the computer program they use works - supposedly to save time so they do not need to go through all the questions Hmm

yoga because the government decided "on advice" no disability is for life and people learn/adapt to their disability enough to cope.

Nothing to do with wanting to save at least 20% off the DLA bill by removing low rate care, (now there's equivilent of mid care and high care) which has since disappeared as a reason despite being popular with non disabled people at the time, likewise the crap about the genuine being protected.

It costs a fortune just with the appeals that are done, many aren't. We've no disability advice centres here and I couldn't cope with appealing mine alone. I certainly couldn't cope with going to court to get it back (here appeals are all held in court and there's only one so you sit with people who are there having (possibly) committed crimes and police).
