Losing are car today because they fucked up PIP

I don't know what I'm looking for from this thread,help or maybe a miracle before the end of the day.

We have a motability car which my mobility part of my DLA paid for.I'd just been awarded DLA for the rest of my life and then low and behold they changed me to PIP.

The change was okay until I had to go for the assessment,I have no idea what went wrong but the lady doing the assessment got everything wrong,she put that I can walk a certain distance and climb stairs,I can't do either I've been in a wheelchair for nearly 10 years now,she stated that I can cook for myself and sort my own medication which is all wrong I have a rare form of brain damage,I'm not allowed to use the toaster and kettle let alone cook a meal and I can't have anything to do with my medication because the one time I did I managed to overdose by accident.

We have challenged the decision and to add insult to injury when my DH first spoke to them they told my DH that someone had forged the date of when they received the information from us(it had been forged they're end by 2 weeks which ment they'd have 2 weeks more than they should to sort it out)they promised to get it sorted out they're end,my DH rang them again 2 weeks later and he spoke to a manager and he also admitted that the date had been forged and that they would have it all sorted.

Well low and behold to get it through on the last day that they had to get it all sorted(by they're own rules)they've signed it all off as being fine(meaning we lose the car)were both at the end of our rope here(me and my DH)we need the car,it is a lifeline for all of us,we have 5DC and 3 of our DC go to school miles away from where we live(they were the only suitable schools because they're all asd)and the car is the only way I can get out,I can't go via bus because of my health(I can need to leave somewhere within a minute)so I'll be stuck in the house.

Were going to appeal,we had to do the same for our DS17(he was given nothing and the courts changed it all and he got his Pip back)but that will take months.

We don't know what to do?If anyone could offer any advice it would be amazing.

Sorry for any spelling mistakes,grammar mistakes ect,I have the braindamage to thank for that.

I'm so sorry. A similar thing happened with both my sons dla and we lost my 10 year old's motability car too. Dh is now doing the school run twice because our current car doesn't fit the dc and their wheelchairs.

Thankyou for all of the replies,sorry I vanished for a while were having to look for a cheap car to get us through the next few months(hoping to God that we win our appeal)and as if this wasn't all bad enough we've just had some really worrying news about a very much loved family member.

MY DH has contacted our MP and he's waiting for him to get back to us.

Beccawhen I said about the questions not being asked what I ment was she didn't ask the questions but she filled out the answers for them anyways.

Is it possible to tape these interviews (audio at least) so you have proof questions weren’t asked?

oh I see, sorry I misunderstood.

lego only with their permission and you must use two cassette tape recorders, hand over one of the tapes at the interview and sign an agreement about what you will use the tapes for. I think they also accept two CD players now but I'm not 100% on that, it can't be done digitally.

If caught recording without permission then they can cancel your claim.

What really annoys me is you cannot apply without them recording the conversation!

Only if agreed in advance and with the sort of dual tape system the Police use, so you get one, DWP get the other as soon as you're finished.
Some advocacy groups have them, try a local fb PIP support group.

The claimant also must provide the equipment it's not provided for you so you need to be able to afford that and be able to carry it.

I think Motability can give you six months grace before you hand back the car if you're appealing but as most appeals take around a year it still doesn't solve your problem. I also believe they will give you a £2,000 payment if you were in receipt of a car before 2013.

Why don't they encourage recording the interviews?

If they are trying to say they are honest then they should allow simple recording provided by them

Otherwise they are trying to hide dodgy interviews

I can see that digital recording could be edited to say something else but why not they provide the recording equipment and you take along the tapes - so everything is honest and open

There is a grace period but its for eight weeks from last payment of high rate mobility to cover the MR (which can actually take longer than that so you can find you don't keep the car for the MR) and the OP has already had that.

Originally that didn't exist.

subtitles because the whole thing is a farce and they don't want any evidence of it. Make people bring their own equipment means they must be able to carry heavy objects and use their hands properly. Assuming of course they'll let you record them.

Not even the dwp have been able to creatively statistically analyse how badly the DLA-PIP transfer has gone and they are very creative with their stats.

The governments independent select committee (which were actually independent) asked for people's experiences with these assessments a year ago. In their response they said it was the largest response any select committee has ever had, and almost a year later they're still waiting on information from the DWP - some has been missing, some blanked out and more than once the disability minister found to be telling lies. It was for all assessments so ESA as well as PIP.

One of the things mentioned was recordings (there was a huge amount discussed)

Very very bad farce obviously. I'm not implying this is in any way amusing for anyone to go through. I've seen many people treated horrendously with these "assessments".

Motability Scheme operators aren't exactly helping the disabled a lot

Reserves of 2.4bn and very high salaries and bonuses for the top execs.
I'm sure there's more recent news on this matter, but it's just to let you know of yet another scheme that is supposed to HELP disabled people falls far short when held up to scrutiny.

And you have to provide the equipment yourself and its mostly obsolete. The last person I knew trying to do this ended up buying from ebay and fixing kit because the permitted list is so hard to obtain.

But hell, if I was incompetent and incentivising "assessors" to lie and minimise disabilities I'd make it bloody difficult for them to prove what I was up to.

The current system of assessing disability for benefits purposes is pure evil - there is no other phrase that fits. It deliberately set up to make it difficult for our most vulnerable people to get help when they need it and the local administrators either don't care or seem to take pleasure in making it difficult. And when proven wrong in court they don't get penalised, they just carry on doing the job.

We're currently awaiting dh new pip award and I'm petrified everytime the postman walks up my path in case it's a letter from them saying a miracle has happened and dh is now cured Hmm so he's no longer eligible.

We are currently preparing for the Tribunal too.

What I also discovered recently that for most/many cases PIP is now awarded for a limited time, ie 18 months/2 years, so it looks like from now on it will be a regular ongoing nightmare.

Was at a relative's Tribunal earlier this year, previously had indefinite DLA, awarded enhanced PIP for both categories and the Judge said it was inappropriate to fix a term. Letter from DWP stated that following Tribunal they had implemented the awards and relative would be contacted "after [month] 2027. not a typo, but TEN years in the future from when the Face to Face took place.

Yesterday, that's nowhere near a year after that Tribunal decision, relative receives a pack from DWP saying they have an Award Review and a new form needs to be submitted within the next 2 weeks otherwise PIP will be stopped etc.

Obviously it's an admin cock-up by the DWP which I'm dealing with, in writing and have asked for a detailed explanation in writing, sent Tracked at over £7 plus a long drive to and from our nearest Post Office for which I've had to pay, but for vulnerable people, it's like harassment.

To go to Tribunal, to be officially told you will be contacted in ten years' time, then around six months later to be told by the same department that you have to have a review immediately or you'll lose your PIP is beyond ridiculous.

blank your relative needs to reapply. The dwp can reassess anyone any time they want regardless of what a judge has said. I was sent a pack dated the day of my tribunal and was told if I didn't want the money anymore it was stopping immediately. I've been reassessed on average every twelve weeks since winning.

The judges have zero power over when someone is reassessed, that's up to the dwp and it does say in /law to do with assessments they can reassess before the date given.

It's something that was mentioned in the parliamentary committee research and reported on in the news on important news day (so buried).

Yes complain but if the form isn't back by the date on it they'll stop your relatives PIP and they'll have nothing and no back pay if they reapply. You won't get a response to a complaint before that form needs to be back.

I've severe anxiety over post now and feel I'm being punished for appealing and winning even though I've managed to get the benefit every time.

We lost our car and have had to find over £600 pound for a second hand car and we are still waiting for the PIP people to send us the confirmation(of they're serious fuck up)so we can start the court appeal so it looks like my DH is going to have to keep ringing them to even get the letter they should have sent us already.

It really does feel like this government hates all people with a disability!
