Had some botox early January, i thought the nurse was injecting in the wrong place and said so,it felt to be more in my nose than between my brows, anyway i ended up with 2 black eyes a swollen and bruised nose and let her know, i was due ua review in 2 weeks,i sent her pics as she was away for a couple of dayswhen she was back she didnt bother to contact me, i spoke to her and she said she would see me in 2 weeks,
I have had botox before and never has anything like this haappned
She said it was because i was thin, im not actully thin, just slim,
I asked her if she would give me a refund, she said she didnt give refunds at all,
I contacted Save Face who some are registeted with, thyey said the people registered with tham wetre advised not to
I am thinking of taking her to small claims court, as it has ruined a family outing, also had to cancel several hospital appointments
IO am very embarrassed as i looked as if i had been punched in the face, bruisimg has gone now but 1 eye still half closed, the other too wide and eyebrow too high
I would appreciate opinions, i know things can go wrong, but no one even other practioners have said they have never seen anything like this and someone administering botox should be aware of where blood vessels are,
She said she injected in the right place, she didnt, there was a red mark where she injected, and it was in my nose at the top,it was very painful ,she panicked and rushed to ger an ice pack, but it didnt help, much ,the swelling went down very slightly
I will remove this pic later as it could be identifying

The bruising got worse after a few days, this is after only a couple of days

TheQueenOfWands · 02/03/2018 16:59

I wouldn't do anything.

If you inject random stuff into your body you have to roll with the outcome.

Heratnumber7 · 02/03/2018 17:05

What does it say on your contract/sales agreement? Is there a clause about bad reactions being at your own risk? FWIW I think you should at least have been offered a refund, but you probably need legal advice as to what recourse you have, if any.

I hope the swelling and bruising clears up soon, OP.

PaperRockMissile · 02/03/2018 17:31

I disagree. You are paying for a service and on the face of it black eyes are indicative of the process not being carried out to a competent standard.

If you are thinking of suing her, the first step is to write a formal letter before action (sometimes called a pre-action protocol letter) setting out your claim.

Take additional pictures if you still have brusiing and date them (2 weeks/3 weeks after). It would help you if you found another experienced reputable botox practictioner who is prepared to say openly that this shouldn't happen in an email. This kind of thing:

"My name is Dr Jane Smith. I qualified as a dr in [year] have been practising as a practitioner of botox since [date]. I have seen the pictures of love my lover (attached) and am told this was following botox. The bruising indiates to me that this was not injected in the correct place because [xyz]."

The letter should contain—

(a) a clear summary of the facts on which the claim is based, including the alleged adverse outcome, and the main allegations of negligence;

(b) a description of your injuries, and present condition.

(c) an outline of the financial loss incurred by youan indication of the heads of damage to be claimed and the scale of the loss ( so here it would be the cost of the botox, suffering/pain/distress for inability to attend family events, additional damage for cancelled appointments and anything else you have had to pay for (additional pain killers).

If you wanted to you could also send a separate letter marked "without prejudice save as to costs" in which you offer to accept £x sum to settle the claim without issuing proceedings.

lovemylover · 02/03/2018 18:44

Thanks all,i know we take a risk with botox etc, but no one should end up in this condition, but it was her attitude too, a friend of mine had a bad outcome with botox, but the lady apolgised and offered her a refund,it was nothing like mine
I did expect someone to say its my own fault, kind of, but i think its a bit harsh,
I have got advice from Trading standards and they have advised me what to do, i have sent a letter of complaint, but she wouldnt give me a formal complaint form, and would not discuss, just blocked me
As paperrock says i paid for a service and expect it to be done properly, she injected in the wrong place,it felt like she was injecting into bone, and never felt pain in the past,
I have no bruising now, but have photos

Also i think as do others she should have asked to see me,she just didnt bother
Anyway thanks again for all comments,

If you inject random stuff into your body you have to roll with the outcome

Because this was an elective treatment does not mean she should have to put up with malpractice! Ffs, would you be saying this about breast augmentation? That if it's substandard you should just put up or shut up?! If mistakes have been made of course she shouldn't "roll with the outcome" Hmm

iklboo · 02/03/2018 19:04

Is she / the clinic registered with the CQC? If so you can contact them for advice, particularly about her technique and attitude.
Did she explain the risks to you and get you to sign a consent form with them on it?

Is she a registered nurse or a beautician / beauty therapist? If she's a registered nurse the Nursing & Midwifery Council might be able to help or signpost you somewhere.

lovemylover · 02/03/2018 19:50

What is the CQC? sorry not heard of it, she is or was a registered nurse
A few people i have heard since have complained about her attitude more than anything, and stopped going to her, and when anyone has seen or known about what happened to me they wont go again,
I did sign a form s cant remember exactly what it said now, also signed saying what any medical condirions i had if any,i have none,i am not on any medication at all
She is accredited with Save face, whatever that meand as far as i know its just to say she is fit to practice, they have said she has done nothing wrong, but they dont know she made me wait 2 weeks to see her, by that time the bruising had mostly gone,, i did send her a photo the day after when my nose was very swollen,it is still a bit swollen

iklboo · 02/03/2018 20:38

Sorry - Care Quality Commission. They can look at private companies as well as NHS premises to see if they're being run properly, up to standard, properly trained staff etc.

You may have to actually raise a complaint with Save Face & ask them to investigate, sending all the details and photos.

I agree with the PP about trying to get an independent expert view as well.

TooManyMiles · 02/03/2018 20:47

I think Paper gave good advice, OP

Without experience of botox, I feel sure that all the film stars who have it don't never end up like you did. This is a case of botchox.

I hope you get an apology and a refund, and that it heals soon.

lovemylover · 02/03/2018 22:35

klboo i have complained to save face and they sided with her, i sent photos too, but i should have told them thay she wouldnt see me until the 2 week review, by then the bruising had faded a lot,
I googled the CQC but it didnt say how or where to check someone
I will try to get another practitioner to back me up i think

OP posts:
TooManyMiles · 02/03/2018 22:47

I meant films stars don't ever end up like this

lovemylover · 02/03/2018 23:47

I WOT GET AN APOLOGY OR A REFUND BUT I WILL MAKE SURE ANYONE WHO ASKS WHERE I HAD IT DONE I WILL TELL, SHE JUST DOESNT CARE
Sorry caps on by accident, [not shouting]

OP posts:
ScreamingValenta · 02/03/2018 23:50

Paper's suggested plan of action sounds really good, OP.

dantdmistedious · 02/03/2018 23:55

Was this a registered practitioner or a random that turned up at a Botox party or similar?

lovemylover · 03/03/2018 10:37

She is registered with Save face, but i am sure she must be registered elsewhere, not sure who with,
She also did my crows feet, which arent good, now i have a crease under my right eye which wasnt there before
She runs her business from home, and advertises it as a clinic, but its just a house, also her website says shes a hypnotherapist, there is only her there, but advertises as if she has other staff, used to work from a hairdressing salon
Who else should she be registered with?
I would have been happy if she had offered to refund me, even as a gesture of goodwill, and everyone who has seen me is horrified that she refused refunds under any circumstances

OP posts:
PaperRockMissile · 04/03/2018 15:43

When you say "you won't get a refund" you don't have to accept this. At the very least you are entitled to a refund and could sue for one if you can be bothered.

Seriously - what you have suffered looks very much like a form of personal injury due to negligence. Google for Conditional fee personal injury lawyeres and go and speak to one. It maybe too low value for them to take on but at the very least you may get some free advice.

lovemylover · 05/03/2018 09:35

I wont get a refund, because she has told me sh doent give refunds under any circumstances, however i am seeing another lady who is registered with the an association which regulaes asthaetic practitioners, and she says it is shocking ,she has agreed to seeme,
I am taking it frther, sent a letter giving 14 days to respond, on advice of TS but i think i have to write another giving her another 7 days, will check today,
The woman who did this wouldnt even tell me who to complain to, or see me me before my review date,so she didnt see it at its worst,

I complained to Save face and they said she had done nothing wrong, on her say so, so no point in anyone relying on save faces recommendations
I will see this other lady and update then
There are only 2 in this area, regulated by this other body
Cant remember the name off hand, but i will look again and post

OP posts:
lovemylover · 05/03/2018 09:39

It is the British association of cosmetic nurses, BACN, also you can look up up registered practitoners in your area,

OP posts:
PaperRockMissile · 05/03/2018 10:03

I wont get a refund, because she has told me sh doent give refunds under any circumstances,

I understand this is what she says. The point I was making is that if you threaten to sue her and/or do actually go ahead with it, she is likely to change her mind.

I've already given you a suggestion - you need a qualified and experienced botox expert (preferably a doctor) to look at your photos and give you a view (as I've said a short email will do to get your case off the ground. it doesn't have to be a formal witness statement) as to whether your injuries are either
A. something that can just happen no matter how careful you are - so no fault of the woman you saw OR
B. highly unlikely to happen if injected in the correct place with care between the eyebrows so evidence of negligent placement or negligent injection.

I'm not sure if you are not listening to me or I am not being clear - but you constantly saying "she doesn't give refunds" suggests you don't understand what I am saying to you.

You need some legal advice and there is a lot of free stuff out there - Citizens Advice, Law Works, Bar Pro Bono Unit.

lovemylover · 05/03/2018 12:35

Thank you, yes i do understand what you are saying, and the lady i am goingto see is saying also that this is negligence, she has never seen or heard of anything like it especially with botox, and hopefully going to back me up in writing
I have already threatened to sue her for negligence ,but she hasnt responded ,and told her i will take it furter, which i do intend to do
I will look at all the places you have suggested, as i said Trading standards [consumer protection] have advised me, and said if i get no response from her to contact them agian

OP posts:
lovemylover · 05/03/2018 12:37

When i am saying she wont refund, i was meaning voluntarily

OP posts:
lovemylover · 05/03/2018 14:04

Also told her i will sue for Negligence, she might think i am just threatening but i am not, i am going to get another opinion on wednesday 2pm

OP posts:
lovemylover · 05/03/2018 17:18

Apparently this woman i went to has a bad reputation for taking the money and not doing anything when things went wrong, and no one had photos.
This is the message i have just got

WWYD if this happened to you
