Data protection applies if people are handing their data over to you to take care of. You’ve a responsibility to handle it properly. For example if FWS have a mailing list, they’ve to keep the information about who’s on it secure.

What FWS are currently engaged in is research. If, to help them with this research, you have to supply them with your personal data, that must be kept securely - eg if they CCd their next email to their mailing list rather than BCcing it, that would be a breach. The information provided must be kept securely, but it doesn’t fall under the same regulations. As when organisations produce methodologically heinous pieces of “research” that set off a global panic about the risk young people with gender dysphoria will kill themselves - the participants’ information would be stored one way & contact details updated etc; & the dumpster fire masquerading as research would also be stored safely but not subjected to any kind of fact-checking process.

And yet again - it is not illegal for clubs/teams to reveal they’ve trans members unless it is the case that i. the member in question has a GRC & ii. the person who discloses that said member is trans became aware of it in an official capacity AND knows they hold a GRC. (Basically, unless someone who’s done a DBS that’s turned up someone has a GRC were to contact FWS, not. illegal. And even then, it wouldn’t be FWS breaking the law, but the numpty who contacted them.)

I agree it is serious but I don't wish any brigading to happen as the victim appears to be in a state of distress because of doxxing by FWSSport (now deleted but archives were made) which was reported to police.

Or have they? I just had a thought. FWSSport are asking the public to send them information on trans women for them to "map". But how do we verify the information that is sent to them? Anyone could make shit up and send anything to them. How will FWSsport ensure it is correct (a principle of the Data Protection Act, remember that? is to ensure all data held is accurate)?

Will FWSsport email clubs and ask them to verify if [name of trans woman a member of the public emailed them about] is a member there? They might want to know it's illegal for clubs and teams to reveal to anyone if their members are trans, they can't do that.

So how will FWSsport know the information they are receiving is accurate or not? Are they going to ask the public to full-on stalk trans women and take photos of them playing sports as evidence?

Sex Matters, from their official account want to “map the trans-identified males”

There has been some back-pedalling, but it’s clear this is a witch hunt - a targeted harassment campaign.

Most of them will just be volunteers running sports leagues, and Sex Matters and FWS are effectively encouraging people to go and harass and intimidate them.

This is despicable.

This sounds like an excellent initiative by FWS (notwithstanding the misrepresentation by one of our resident TAs). No woman should be prevented from participating in sports or endangered by participating by the inappropriate presence of a man. Keep women's sports single sex.

Mara Yamauchi is an advisor to SexMatters; I doubt she's involved at an operational level.

But even if she were, this sort of data collection would fall under the exemption for journalistic or academic research with the intention of making a publication in the public interest (Schedule 5, Part 5, paragraph 26 if you want to look it up).

Are FWS compliant with all of this? I doubt it, they are breaking multiple laws here.

The Data Principle principles include:

The Law- Collecting and using personal data needs to be done lawfully, and there are additional requirements when it is related to minors or vulnerable people (such as this case).

Fairness- Data can't be processed in a way that's unexpected, discriminatory or misleading. Any adverse effects on individuals need to be evaluated.

Transparency- FWS need to be a lot clearer about what data they are collecting and what exactly is going to be done with it. They haven't said much other than they will "map" trans women in sports. They also need to provide a privacy notice to the public explaining all this. These requirements apply from the start when data is being collected, but I don't see any privacy notice.

There's a section on purpose limitation. This may need to secure the consent of the trans people FWS are collecting data on (they are doing this? right? right?)

Data minimisation- data collected must be adequate, relevant and limited to what is necessary. The screenshot above shows FWS are asking for a lot of info about trans people e.g. "who they are" what does this mean? Why do FWS want names of trans women and what purpose are these names for?

Accountability- As a registered charity FWS need to provide evidence to the ICO they are compliant with all principles.

There is also the Gender Recognition Act where sports teams/clubs etc are not legally permitted to identify to anyone if they have a trans member. It's a protected characteristic, FWS cannot legally demand to know who is trans.

Except you are willfully misrepresenting both the law and the intention of both sex matters and for women Scotland. They are asking for information about teams, leagues and competition's NOT individual trans members, 2 completely different things (your gotcha post didn't come from them) also only staff who found out about a person having a GRC as part of their work are forbidden to speak about it under the GRA 2004. However they are NOT asking for details about anyone's GRC status (which you know but doesn't fit with your false narrative).
It doesn't matter if a male has a GRC or not all males can legally be and should be banned from female sports, services and spaces (read the equality act).
I have an honest question for you @Christinapple why are you so scared of people collecting accurate data on the number of males cheating in women's sports? Is it because you're afraid that people will start to object to the damage these men are causing or that the numbers are so large that even this Labour government will have to act to protect women sports from male cheats?

You appear to have Germany’s new laws on self-ID & the very limited provisions of the GRA confused. It is illegal for someone who became aware in their official capacity that an individual holds a GRC to (other than in a few very specific circumstances^) share that they do/otherwise disclose their transgender status without said individual’s consent. Simply to state that another person is transgender is not illegal.

^ this obviously wouldn’t qualify under the exemptions; but nobody is going to break the law to assist FWS if there is even anyone in the country who would be in a position to do so!
