If Rowling’s lawyers are doing any additional work at this time, I assume it’s to establish how on earth a police officer decided that her Foolish Law Day TwiX Thread met the threshold for recording as a NCHI:
Under the Code of Practice on the Recording and Retention of Personal Data (‘the Code’), the personal data about the subject should only be recorded where the incident:
“presents a real risk of significant harm to individuals with a particular characteristic(s) and/or a real risk that a future criminal offence may be committed against individuals or groups with a particular characteristic(s)”.

How came I to know of this? IW mouthing off on TwiX. Including repeatedly tagging the lawyer named in Imane Khelif’s case. Because what court could fail to be impressed by this pseudo-Stasi name-taking; & what lawyer wouldn’t interrogate the surrounding circumstances of i. IW’s harassment campaign & ii. what the thread ACTUALLY SAID?

I don’t think IW took legal advice before posting those tweets. Rather, IW is buoyed by their little sliver of letter:
[NAME REDACTED] states that in determining that this matter was not a crime, the second test was whether it was a Non-Crime Hate Incident. This test is clearly set out the that a Non-Crime Hate Incident (NCHI) means an incident or alleged incident which involves or is alleged to involve an act by a person which is perceived by a person other than the subject to be motivated - wholly or partly - by hostility or prejudice towards persons with a particular characteristic.
[NAME REDACTED] confirms he was satisfied that this threshold was met and as such a NCHI was recorded and as such safeguarding measures were addressed with you and a harm reduction plan was recorded with the offers of safeguarding.
I note in your original submission you requested that this matter be passed to the CPS for consideration and also that further advice is sought. As detailed above, I am satisfied with the

It’s a deeply unfunny joke that Northumbria Police mention “harm reduction” & “safeguarding” in this particular context. I do hope what was offered was based on “stop harassing the woman & she might stop replying” but that seems too sensible.

Perhaps JKR will point out all the other tweets which do not, apparently meet the threshold. And ask why. Including all those from Willoughby. And find out why she has been singled out.

And I guess now's the time she reports Willoughby for malicious communications.

it is pretty obvious she doesn't give willoughby a single thought from one moon to the next, but that would send them into the stratosphere. They will bury themselves in a whole stream of furious malicious communicating.

Or she can just ignore it, and not feed desperate attention seekers

If that's the case, then I'd like to thank him for his work in exposing the absolute farcical and illiberal nonsense that is NCHIs. These should be scrapped, and should never have been invented in the first place.

Can I just check - this man has had an NCHI recorded against a woman for calling him a 'man'?

I assume he has chosen a woman who is unlikely to do a SAR and seek further legal action on this, and/or take legal action against him for harassment and his own public abuse of women on social media?

That headline from the Independent made me chortle. 'JK Rowling DELIBERATELY MISGENDERS trans activist India Willoughby'.

It instantly made me think of that Blackadder the Third episode with the actors where Blackadder deliberately keeps saying 'Macbeth' so they have to go through their elaborate ritual to exorcise the bad luck. Not quite as elaborate or as ludicrous as initiating legal proceedings, but the self-aggrandising pomposity of the actors is certainly familiar.

How does this fit in with the College of Policing's new code on recording non-crime hate incidents?

"Consider, using common sense reasoning and drawing on supporting information where available, whether the subject involved in the incident in question was motivated by intentional hostility or prejudice towards a particular characteristic."

I think it's highly questionable to argue that JKR's tweets met this threshold.

This will be an important one. I think Willoughby has done an amazing job of highlighting male abuse towards women through Willoughby’s constant demonstrations of it.

It will be a needless distraction for JK to deal with this. But then again, she does seem up for it. If she can fight this, it will set the precedent which is what she was willing to do. JK is a brave woman.

According to that tweet Northumbria police think calling a man a man is a hate incident worth recording. That definitely needs exploring further.

I'm also interested in how high a police officer has to be to be allowed to record non crime hate incidents on a national register. Inspector, Chief Inspector or can a lowly, fresh out of college Constable make that decision by themselves?

Anyway, I will continue to call a man a man, I could do with three meals a day and no electric bill to consider right now. Bring it on IW.
