The key words are 'any other procedure which requires action to be taken or information to be given that depends on whether the person is to be treated as being male or female".

The police position is that they must respect the declared gender of the person when giving information to protect the privacy of the person.

Even "trans-identifying man" may not be clear to many people. We Need "X, a man who identifies as a woman ., . . " (or something even more blunt).

I think this is why we should stick to sex and/or biological male or biological female

I hear people refer to 'gender at birth'. There is no gender at birth, its an oxymoron. There is sex observed, sex in utero.

Thames Valley Police have now made a response to the statement by Matthew Barber which criticised them for referring to the suspect as a woman. They say they are acting in line with "college of policing authorised professional practice":

A person can say they feel male or female, thats up to them but the sex of them is what should be referred to

It should be the norm to say 'transwoman' or similar, because transwomen aren't women, and we shouldn't be pretending male predators are female.

Absolutely spot on statement from Matthew Barber. I’m sure he’ll get grief from the usual suspects but his wording is clear and factual with no hint of any bigotry, just reality.

51 year old arrested in Witney for sexual offences is male

11 Feb

Last week, a child was reported missing and later subjected to a serious sexual assault in Oxfordshire. My greatest concern is for the victim and ensuring they receive the support they need and I would urge anyone discussing this case to remember that there is a real child behind all of this.

From my discussions with the Force over the last few days, the operational policing response by Thames Valley Police appears to have been exemplary. The victim and the suspect have been identified by CCTV operators who were able to direct officers immediately to safeguard the child and arrest the suspect. The case is being handled by the specialist Child Abuse Investigation Unit and the suspect has been charged and remanded into custody. This demonstrates excellent policing and I commend the officers involved for their work to tackle predatory sexual offenders.

I am concerned by the description of the individual, Osareen Omoruyi, as a woman. Thames Valley Police have, mistakenly in my view, relied on the ”self-described gender” in publishing a press release that incorrectly states that a woman has been charged with these offences.

My understanding is that magistrates in Oxford have quite rightly remanded Omoruyi to a male prison.

So why does this matter? I emphasise again that the police, the CPS and the courts have all acted swiftly to protect a child and in due course, to be able to present evidence to the court that will hopefully secure a conviction.

Speculation on social media however is already having the potential to detract from this important reality.
The police and other criminal justice agencies must deal in facts, as best evidenced to them at the time. Any failure to do so risks damaging public confidence and overshadowing excellent policing in the interests of public safety.
In my view it was clearly wrong to describe the suspect as a woman. It is important that the public, and possibly other victims have a clear understanding of the facts. It is important that statistics around sexual offending are accurate.
In a free society we are, and should be, able to live our lives at liberty to describe ourselves however we like - providing it doesn’t affect other people. In cases of serious sexual offending when public protection is at stake the vast majority of people will rightly expect the criminal justice system to deal in facts and nothing more.

The accused in this case, Osareen Omoruyi, is a 51 year old male.

Suella Braverman, lamentable though she is on many issues, when she was Home Secretary told police forces not to refer to transwomen accused of sex offences as women.

Is it Labour or Conservative defined though, or is it the neutral civil service being successfully lobbied by an aggressive group? I think all political parties should call it out tbh as they should be more aware of legislation than Joe Public. Let's put the blame squarely on those people behind the scenes, not the voters

I couldn't agree more. This is currently a tory issue ! They should be disgusted in themselves for allowing this to happen. I will never vote for them as they have proven their disrespect and disregard for women.

My point was aimed at people's main comment about this disgraceful story, was to aim it at a party that is not even in power, rather thab calling out the people who are allowing this to happen.
