Fewer than five trans prisoners still in female jails

Fewer than five transgender women are being held in female jails after a major transfer programme in the wake of the <a class="break-all" href="https://archive.ph/o/YG8Er/www.telegraph.co.uk/news/2023/07/02/transgender-rapist-isla-bryson-prison-transphobic-abuse/" rel="nofollow" target="_blank">Isla Bryson scandal.

Around 10 transgender women are believed to have been deemed potential security risks and <a class="break-all" href="https://archive.ph/o/YG8Er/www.telegraph.co.uk/news/2023/07/16/trans-prisoners-moved-out-womens-jails-isla-bryson-moj/" rel="nofollow" target="_blank">moved out of women’s jails following a tightening of the rules in prisons in England and Wales.

The Ministry of Justice (MoJ) imposed a retrospective ban on transgender prisoners with male genitalia or with a conviction for violent or sexual offences to be held in women’s prisons.

It was introduced by the then justice secretary, Dominic Raab, after Bryson, a transgender woman found guilty of raping two women before she transitioned, was sent to Cornton Vale, an all-female prison.

The <a class="break-all" href="https://archive.ph/o/YG8Er/www.telegraph.co.uk/politics/2023/01/16/rishi-sunak-strikes-nurses-news-latest-keir-starmer-brexit/" rel="nofollow" target="_blank">subsequent outcry forced the Scottish Government to reverse the policy and led to a review of the rules south of the border.

According to new MoJ data, the number of transgender women in female jails has fallen to between zero and five, excluding those in possession of a gender recognition certificate. The MoJ refuses to be more precise because of the risk of identifying individuals.

The SPS's review is finally complete. It started in 2018. A tweet by KPSS -

'Today sees the release of the long-awaited revised SPS Police for the Management of Transgender People in Custody. We are astounded and dismayed.

This review has been five long years in the making. The process, which we were invited to take part in, was presented to us as comprising extensive and in-depth research that would provide a firm and methodologically sound evidence base for a new policy with SPS was determined would get it right.

What we have before us is a document so lightweight that it is the most risible attempt at a policy I have seen. Where are the details? Where is the evidence? But, most importantly, where is the safety of women in prison?

After the justifiably outrage when the convicted double rapist Adam Graham was sent to a women’s prison, SPS put in place interim measures to exclude all male prisoners convicted of sexual or violent offences against women or girls from being held in the female estate. Today’s policy sees a departure from this exclusion and puts in place provisions where a male rapist could be transferred to the female estate where the risk he presents to women is deemed “acceptable”. Let’s be quiet clear: there is no degree of risk a convicted rapist presents to women that is ever “acceptable”.

Today’s policy is in marked distinction to the Ministry of Justice police that was released earlier this year:

Where the MoJ excludes male offenders convicted of any sexual or violent offence, the SPS has no problem sending the to a women’s prison so long as the victim was male.

Where the MoJ excludes any male offender with intact male genitalia, the SPS seemingly trusts men to behave themselves provided the haven’t assaulted a woman.

Whilst the MoJ policy represented a marked shift and a positive step that we can look to build on, the SPS policy is shameful.'

So basically any man who wants to rape his way around women’s prison can get a certificate saying he’s allowed to do so.

Ffs.

So the obvious next step is that they'll all get GRCs. It's cheap and easy.

And then that loophole will have to be closed too, because they'll crack on with damaging women again until it once more reaches levels of grotty publicity where people start to say ok, that's going a little bit too far.

The only answer to this in the short term is hand out GRCs with a packet of bloody smarties, throw them out of the windows of Whitehall like confetti for all I care, but they cannot equate to access to female single sex spaces including prisons. This comes back to again and again, there are boundaries to how far any male person's transition can be permitted to extend. There have to be. Because other people have rights too.

And then we'll need to move to the last step of getting rid of the GRA because it's a nice idea in theory but is a fucking terrible idea in every way in practice. And men will push this and any loophole until it's completely broken. They can't help themselves.

And we’re supposed to believe a GRC is “just admin”.

Re risk:
"Under the new policy - which will come into force in February 2024 - a trans woman would not be allowed to move into the female estate if they had been convicted of, or were on remand awaiting trial for, a crime that harmed a female - unless there was "compelling evidence that they did not present an unacceptable risk of harm to those in the women's prison"."

Steadfastly ignoring that the presence of a male in a women's prison will be harming females.

I'm not convinced there are any safeguards in place to prevent a violent male in prison, from applying for a GRC and getting one. The GRA must be repealed.

Agree. There should be no men in women's spaces regardless of GRC. If TW are in danger in men's prisons they should be protected but women and women prisoners are not support humans. They deserve safe, single sex spaces.

As far as I’m concerned, a transgender woman is a female who wishes to be considered a man.
A man who wishes to be considered a woman is a transwoman.
The words we use are very important to ensure there is no confusion. Someone reading the article may well think the same - and question why women who wish to be considered men are sent to the men’s prison estate.

Personally find it far clearer to talk about 'trans identified men' and 'trans identified women'. It puts the emphaisis on the 'identity' part of the equation whilst preserving and making the clear the reality of sex.

There really is no such thing as 'someone in the wrong body' - no matter how they feel; and as such there is no such thing as being 'genuinely' trans. All is about feelings and self perception; but self perception is not the exact same thing as reality.

Annoying last couple of sentences! Having a high degree of confidence in a low level risk is still not good enough.

Men no matter their risk level or the fact they may have a GRC should still be in the women's prison estate.
