NDN using our allocated parking space, not their own!

Our neighbours have started using our allocated parking space instead of their own allocated parking space.

We've spoken to them but they have continued. The view of their space is not a clear line of vision.

What to do next???

Assuming you’re in England or Wales, I wouldn’t block them in or put up a homemade £50-a-day sign. Either could create a fresh legal problem.

As you’re freehold, first check the transfer, title documents and estate plan. The important question is whether the space forms part of your title, whether you have an exclusive right to use it or whether it is allocated under an estate parking scheme. That should also clarify whether there really is any “visitor loophole”.

If the space is exclusively yours, parking there without permission may amount to trespass. Keep dated photographs and confirm in writing that they do not have permission to use it. A lockable bollard may be the simplest practical solution, but check the deeds and estate rules first in case consent is required.

But here in lies the problem, its illegal to obstruct access to a road/highway. Hence why you can have a car towed when you are on your drive and blocked in, but can do fuck all if drive is empty.

As others suggested, block them in, ask them to move every single time....no matter the time!

Or put up a bollard.

I'll stick my neck out here @NDNUsingOurAllocatedParking and say I have NEVER understood the Mumsnet enthusiasm for a bollard in your own parking space.

I mean, what a longwinded PITA every single time to use something that is legally your property in the first place.

On the other hand, registering your parking space with a service like JustPark. Perhaps for an hourly fee of £20 and a very reasonable daily discount of £100? Put a couple of signs up at the end of your space. Take photos & pursue any loss in due course through the small claims court.

Or just knock their door the first time they do it after the signs go up to be kind. You could hand them a paper invoice with the web link with details of how to book it for future use. Should put them off a repeat episode more convincingly than asking nicely!

Put up a sign with a date that you start to charge from
£50 per day or part day has a nice round feel to it
It's your land, they can use it - for a price

What do you mean by permanent onstruction to their line of sight? Do you mean between their house and the space so they can't see the space feom the house, or it is more difficult to park in it due to an obstructed view? Either way they are being unreasonable. But we can't advise on what to do without more info eg in a block of flats I would get the building manager involved.

Would a flow diagram suffice? Drumroll please:

Our property > our allocated parking space

NDN > permanent obstruction to line of vision > NDN's allocated parking space

And their MIL, who has also freeloaded in our space, looks like a MNer, you know the type.

Just do a diagram. No one will be able to identify your house by that.

Exactly this. A visitor cannot use your property through a loophole. Unless of course you're saying the parking spot isn't strictly speaking yours that you own. If it's yours, it's yours and nobody else's. If it's anyone's well......you must have plans when you bought the place?

Block. Them. In. And then categorically refuse to move until the following morning, say you've drunk a whole bottle of wine, anything. When they can't get out when they need to they'll soon stop it

My neighbours put a planter on theirs because they didn’t drive and random neighbourhood cars kept using it.
