Child Maintenance-Should fathers on benefits pay more?

My ExP owns his home outright, receives in excess of £1,200/month in disability benefits and works cash in hand. His only outgoings are food and utility bills for himself. Is it fair that he only pays £7.00/week maintenance for our DD10? For context, I am a lone parent and own a mortgaged home. I slightly exceed the threshold for universal credit. My disposable household income after mortgage and bills equates to half his, but with two people to support. Is the system broke? Should disposable income be considered by CMS when paying parent is in receipt of benefits?

I think the real issue here is that he is working cash in hand and paying the absolute minimum in CMS because his true income is not being declared.
The how and why he is on PIP should not really matter, and PIP should not be regarded for CMS anyway due to the fact it is awarded based on how someone's disability affects them, and not what money they have.

But until cash in hand work can be better detected etc, then I am not sure what the solution is.

Back when we were young my dad was ordered to pay 15p per year for the three of us never paid a penny he was on benefits at the time dads on benefits and child support has always been crap

Perhaps PIP claims on mental health grounds need to be more carefully considered to be deemed sufficiently serious to make an award? Eg being under the current care of a psychiatrist/cpn. Should a GPs letter and a continuing prescription really cut it?

It's very rare to get PIP for any condition if you're managing to work full time. Full time work usually (although not always) counts against anyone trying to claim. Hence why so few claimants are working. He probably knows this and it's why he's doing it unofficially. He will likely have told them he can't work.

But in this case he requires no aids or adaptation to work, unless you count the coke to give him a pep in his step?

I never understand why people need the extra money on PIP when they work? Its like when the government allow alcoholics to claim sickness benefits which is more money and they don't have to look for work, so obviously they are being given extra money to sit at home and drink even more , where's the logic in any of the government systems?

I certainly don't understand why the CSA Dept don't do more to help parents who are claiming CSA for their DC. It all seems a bit useless really I'm sure back in the day 20 years ago my ex was paying £5 a week for our DS out of his benefits so it hasn't gone up much in 20 years. I stopped claiming it coz there was no point and he drifted off never to be seen again. How do they let the parent having to pay CSA owe so much in arrears? Especially when they claim benefits or work, they are quick enough taking money out of benefits or wages if you owe the council or the government money.
The whole system is ridiculous.

Yes, drives there, talks to customers, negotiates contracts, does the work and makes sure he gets paid. I’m fairly certain the psychosis only kicks in again when he completes his PIP forms..but then again someone has to subsidise the drug habit. why not the taxpayer?

But PIP fraud is just 1%

Well that doesnt make sense drug induced psychosis is usualy over fairly quickly
You cant continue to claim disabillty benefits .

I don’t know what additional expenses drug induced psychosis incurs, apart from the £300/wk it takes to get high at the weekend

Sadly the system is made by man to serve the man. I have tried to increase cm because of undeclared income but they didn’t even bother to call the dad to ask about this…they said they can’t see on hmrc income …how these dads can live with those scams on their own kids is beyond me.

Actually as technology has advanced I am going to have to disagree that you don't need a phone potentially with internet.

Whilst I've not had to claim benefits on many years I have for many other things in life needed to have 2 factor authentication to access apps, and that absolutely does require a phone and annoyingly most old brick phones would not support the apps/technology needed to do so.

So we need to get past having a smartphone/internet being seen as a luxury and understand in these times it is very much a necessity.

THAT said....NOBODY NEEDS the latest fucking iPhone or a £50pm contract 🤦🏻‍♀️🤷🏻‍♀️ I bought my phone second cheap hand and have a £20pm all in SIM that covers everything.

Not just Netflix is it, broadband, phone contract, Amazon prime Disney plus, sky, you should have nothing if you can’t pay for your kids, no luxuries

You need a smart phone to access your UC account.

I completely agree that the taxpayer should not pay more. Should the paying parents benefit entitlement be reduced more? Benefits increase in line with inflation, I don’t think this has been the case with statutory maintenance though?

Do you mean his PIP? Or do you mean his basic universal credit benefits? His PIP is meant to be used to help him pay for the extra expenses that his disability incurs, and his standard Universal Credit is to cover his basic living expenses. Does he get the Limited Capability for Work component of UC? If he does, because he’s claiming he can’t work, and is working CIH, that needs reporting.

His child maintenance should come out of his earnings, not his UC, so the solution is to make his earnings be declared, which is easier said than done, and may involve him being prosecuted for benefit fraud.

He sounds like a horrible feckless excuse for a father, I’m sorry you’re having to deal with this.
