Clinton created the role that ICE took over from the INS with the Illegal Immigration Reform and Immigrant Responsibility Act (IIRAIRA). It was just reshuffled under Bush after the creation of the DHS after 9/11. Their actual roles/responsibilities and methods were enacted with Clinton’s legislation.
