Resigning after maternity leave. Do I have to pay anything back?

Sorry, I am sure this has been done to death but I am way too tired to read through any old threads. Basically I've been back a few weeks and find that it's breaking me. Just can't do it. If I resign, will I have to pay anything back? I took the whole year off, my company only paid the legal minimum of maternity pay, plus they kept my private healthcare scheme and my pension scheme going. Any advice greatly appreciated.

I know you don't have to pay anything back if you ony had Statutory Maternity Pay but not sure about the healthcare and pension.

Could you talk to HR?

If you are public sector I think you will - but if you can face working your notice (in teaching it's 13 weeks), you won't. Probably best to ask your HR people

No you won't have to pay anything back. If they only paid SMP you keep that regardless, and you are entitled to your benefits during maternity leave regardless of whether you leave afterwards, so you'll be fine.

Even if your company did pay more than SMP, if they wanted to be able to claim it back they would have had to notify you beforehand.

You will have to talk to your HR but mine will owe me money as they will over me 5 weeks holiday pay.
