Probation and Sick Leave

I started a new job in Jan and part of the contract was 3 months probation due to suffering badly with depression etc I was signed off at my gp's, hv's and cpn's insistence 4 weeks ago for 3 weeks, last week the decision was made to extend this until the end of April.

My probation should have been reviewed 5th April but as I am on sick leave it hasn't. My work have contacted me to request I attend a meeting either at work or some place else convenient to discuss my probation, from the phone call I made to them last week, it seems that they are obviously wanting rid of me.

Can they actually force me to have this meeting? and more importantly terminate my contract stating that I didn't perform well during my probation?

If it makes any difference my sick line states I am unfit for work due to family circumstances. These are the fact ds's dad died last year and I am not coping with that and another death etc, but my manager has contributed, I feel to me being signed off by not allowing me time to attend a GP appointment or making me chose between attending university on an afternoon when I make the time back or going to the doctors.

If you've been there less than a year they can dismiss you without even giving a reason if they want to, as long as there's no discrimination. It doesn't sound as though your sickness absence is due to a disability, so yes it would be fine for them to terminate your employment.

Your best bet is to convince them that you are now fit for work and the absence will not continue to be a problem. I would suggest you attend the meeting either way.
