Not very clued up on resigning malarkey

I am at the end of my 52 weeks maternity leave. I have 1 month left so need to give my notice if I am not to return (99.9% sure I won't but need a couple more days to decide). Anyway, I think I am correct in thinking that I must resign one month before my expected return otherwise I'll have to go back to serve my notice period won't I?

Also what happens to any holiday time I've accrued? Do I get paid it (am on SMP of zilch now as per final 90 days of SMP rule) or should I try and use it as my 'notice' and not resign until I am due back.

Am very confused about all this and work are horrible so would rather not talk to any of them about it.

Could someone please explain what the procedures are, generally though I accept that there will be some variation between employers. Thnks

I'm sure someone will come along who knows for sure, but I think it is now 8 weeks notice that you need to give.

Have just checked government webiste. If you decide not to return to work, you give notice in the normal way. So your notice will be whatever it is for your employment.

If it is 8 weeks what happens about the fact that I may not have childcare in place in order to be able to return?

Can you tell I've been burying my head in the sand?

It's 8 weeks notice to change your return date. If you want to resign it's your normal notice period.

You will get paid for any holiday accrued but not taken. You could not resign until you go back and use your holiday as your notice period but really there's no point. You'll get paid the holiday anyway and there's always an outside chance your employer would rather you come back and work for a month and then pay you your holiday at the end.
