overpayment recouped, now seems it was not an overpayment. ML issues. Flowery or any payroll people out there?

I have been on maternity leave from 11 November 09.

Had baby on 28th Nov, recieved payslip on the monday, stating normal wage. A couple of days later get call from union rep at work to say he was at hr office, paperwork not recived (MATB1 form etc), it has been lost, or something. Means my wages were incorrect (which i knew but not had a chance to call let them know). He asks for copies, which i have, comes to get them. I email payroll to ask how much my wage should have been, ie what overpayment, if any, has been made. This was on my assumption of 6 wks at 90%, from 11th Nov. Email back to say that overpayment was made by £xx and this would be adjusted in my next (december) pay packet, and was given the total figure i would get in December. No pay slip received, but figure paid was as rhey stated, so, overpayment sorted, back to where i should be.

I received a letter from them today advising me in writing of how my ML pay will be made up, as I get some company pay also.

It says, as well as other stuff, this:
SMP and CMP is payable as follows:
For the first 4 weeks (28 days): Full Pay.
For the next 2 weeks (14 days) of leave 90% of your average pa. If the actual 90% pay exceeds the average 90% pay you will be subsequently be paid the difference.

For the next 12 weeks (84days) of leave 90% of your average pay (maximum limit £123.06) plus half pay where applicable [ie, if i return to work, which i will be and signed to tell them so].

[ - the rest is SMP]

Te amount i was apparantly overpaid was a resonable amount (around 90% f mywags) when in fact it should have been ony 90% of around 3 days worth). Given that it states full pay for the first 4 weeks? (get paid a month in hand). So my wage should have been pretty much full pay? And the December wage should have been 31 days-14 days at full pay, then 14 days at 90%

I just want to make sure I get this right before i -go-- mad send another email.

So you should be getting 4 weeks full pay, 2 weeks 90% pay, then 12 weeks half pay plus SMP?

I would suggest you work out yourself exactly what you should be getting each week, and at the same time write to payroll requesting a full breakdown of what you should be getting, and how your November and December pay amounts have been calculated as you are not clear about it.

By asking them to do that, if they've got it wrong they will probably notice and put it right, and if they haven't got it wrong or don't notice, you will have the information you need anyway.

Flowery - i have the december breakdown, and to be honest, it is written as gobbledegook! It is broken down into this, that, the other, then minus my normal whole wage to reach some figure a bit less than my normal pay. I cannot see where the overpayment was deducted, as it is not on there, but was told it would be, and the figure i received was around what I would have expected with the deduction (unless they have averaged the overpayment and underpaid me for Dec which seems possible?)

I have emailed them explaining my confusion and asking for clarification in a way I understand it, as the way I see it, my November pay should have been normal pay, just with different 'coding' on my pay slip, and my December pay only marginally different. No response as yet. I am sure they will now say its too late to sort this month!

The half pay i get, that is what I got last time, and yes, half pay plus SMP. It is the 90% and the actual/average that I do not understand!

I am glad it is not just me that is confused!
