is this discrimination?

Hello!
I work for service within a local authority which when I took the job was contracted to a private company. SInce then we have been taken back in to the LA and have been TUPE'd over. This happened three years ago and despite many promises we have not been harmonised to the LA's terms and conditions. As a result of this I am currently on the legal minimum when it comes to maternity rights and benefits. The LA offers a further 12 weeks of EMP, which I am not entitiled to. I am the only female in my department, so the only female in the whole of the LA subject to this. Do I have a case for discrimination?

Probably not I'm afraid.

My employer has taken over many other businesses and therefore has about 4 or 5 different maternity policies so what you get depends on who you started work for. Some just get basic, some get enhanced MP. There have been various rumblings about harmonisation, but nothing has ever happened.

It's not discrimination of any kind, but it doesn't sound fair. Did you not have anything in writing about harmonisation? What about the unions are they involved?

I have a set of minutes signed by my Boss stationg thqt it would all be resolved by the 1st April 2009. Needless to say this hasn't happened. The union have been far from helpful.
Adding to this the fact that he hasn't even aknowledged receipt of my maternity certificate and request for maternity leave despite me giving it to him in February and there being no maternity cover for my job I'm a little stressed to say the least.

Do you have a full-time union officer? There is usually one floating around. Additionally, give someone in HR a call about this.

In your shoes I would write a letter setting out all that you were promised and a request for it to be sorted as soon as possible.

he made me cry today and accused me of lying. Luckily I have a record of what was said in the meeting and have put in a complaint about him. I hope to hear from HR within the next couple of days.
