Part time hours / bank holidays

I guy in our office is going part time - he will have holidays on a pro rata basis of his full time hours.

He is in dispute over his contract and won't sign until it is resolved. He will be working 3 full days and these days will be on different days each week depending upon meetings etc.

The company are saying that when it is a bank holiday week, he will still expected to work his 3 days - he thinks that he should only work 2 (as all other full time staff get them off).

What do you think? Thanks

Neither are right. His leave entitlement should be pro rata what the full timers get, and that includes bank holidays. So he should benefit from bank holidays but not get an extra day off every time full timers do.

So if someone working 5 days a week gets 8 bank holidays, as he is working 3 days a week he should get 8 / 5 x 3 = 4.8, rounded up to 5.

At my company p'timers are credited with a prorata amount of hours on annual leave for bh's (3/5's of a working day). You can therefore choose to use that against the BH or work an alternative day and take it as AL at another time. As his days are not fixed ot include a Monday I don't think he can insist on getting it "free".

Under our system you'd get creditted with .5 of a day 's hours which they'd proabbly choose to use against the Monday BH, just as you employee would be creditted with .6.

The way our company does it is that they work out how many hours of holiday you get a year as a full timer (inc BH), and then prorata that - so my colleague who does 29 hours a week gets 200 hours (or whatever it is) x 29/37.5 to use - as she doesn't work Mondays, she gets all of that to use as she likes, but those who do work Mondays have to use 7.5 hours out of their total to cover a BH

I always prefer to keep it as simple as possible, so if someone worked half days five days a week, I'd just give them the same holiday as a full timer on the grounds that one day off for them would be 3.5 hours rather than 7, or whatever. Obviously that wouldn't work if the hours were not the same each day.

Lots of companies do systems where it's all worked out in hours though, that certainly means no quibbling about entitlements.

Thanks - I actually work Mon-Fri 5 hours a day, and I get all the bank holidays plus 25 days holiday.

I was starting to panic there as I thought maybe if this guy starts to rake all this up, I may lose my rights to Bank Holidays too, so thanks for putting my mind at rest. This guy was saying me to that as I was entitled to them on p/t hours, then so should he.

Explain it to him with the hours examples people have given.

As part timers you are both entitled to the right amount of time off proportionate to the hours you work. As you work 5 days a week, the easiest way of expressing and managing your holiday is by saying you get the same number of days a as a full timer, but actually you don't get the same amount of time off as a full timer.
