Going back to work P/T and trying for Baby no 2 - what are my rights?

Hope someone can advise me?

I am due to return to work next month from Maternity Leave with my daughter. I am returning part time, 3 days a week in a role quite similar to my old role. My partner and I would like to try for another baby as we would like the age gap to be quite small with them, but I am worried about what my rights are with regards to maternity leave and pay if I go back part time and get pregnant almost straight away?

Would I only be entitled to 3/5 Maternity Pay as i would only be working 3 days / 5?

My company only do SMP, no additions, so would I be entitled to full SMP regardless of the hours I work?

Do i need to be back working there for a certain amount of time before i would be eligible for SMP and Maternity leave again?

Also, the company I work for are being taken over by another, would this effect my service and therefore my maternity leave and pay?

Sorry for all the questions!!

SMP is based on how much you earn. The first 6 weeks are 90% of your average weekly salary, the next 33 weeks are at a fixed amount for everyone, regardless of their earnings.

You don't have to go back to work at all to be eligible for maternity leave, everyone gets that regardless. In terms of SMP, the only potential problem is whether or not you are earning at the right moment. The 'average weekly wage' amount used for calculating entitlement to SMP and the amount you get is based on how much you earn from week 17 to week 25 of your pregnancy. But as long as you are back at work and earning enough at that point to qualify, it's fine.

If your company is taken over, your length of service will be protected and your maternity entitlements will not be affected.

Do you know what the "earning enough to qualify" is? I read on one website that it is over £90 a week, is that the correct figure? I am worried enough at the moment at the thought of going back and now finding out about the takeover I am twice as worried!

Yes, it's in the link, first section 'Who is eligible?', you need to be earning an average of £90 a week gross.
