Question about SMP and moving between Trusts for NHS employees

I've got a question about my maternity pay. I am currently on maternity leave (starting this week) and I have applied for a new job in a new Trust in another part of the country. The reason for this is that we need to move house because of my DH's job, when I got pregnant and applied for my mat leave I fully expected to go back to work in my old Trust.
I wanted to know if my maternity leave is payed by my Trust or the NHS. Who is actually my employer?
If I were to be offered and accept the other job to start there when I finish my mat leave. Will this mean that I will have to pay back some of the pay I have received, just like would happen if I weren't to go back to work for at least 3 months after maternity leave?
I find this all very confusing and can't work out how changing Trusts would affect me and my pay. I've tried to work it out from reading the mat leave policy of my Trust, but I find that confusing too. So if anyone knows the answers to my questions, it would be greatly appreciated.

I did that, I went on Mat leave from job in London, then re-located to Chester. As long as you go back to an NHS job for at least 3 months you will not have to re-pay anything. It doesn't matter if it's a different Trust.

Actually, I think it DOES matter, but wouldn't like to say for definite. I'm sure I remember reading this on MN at some point recently. May be worth searching for.

i changed trusts while on mat leave.
your employer is still the NHS, so you needn't worry which trust is paying for it.

Here is the recent thread. As I understand it your employer is the NHS itself, so changing to a different Trust doesn't matter for you, your continuity of service is preserved.

How the finances are worked out isn't anything you should have to worry about - that's for them to sort out between them.

Do you have the section from the maternity policy - if it's a sentence or two do you want to bung it here for us to interpret for you?

i'm in a similar position and am applying for jobs whilst on matleave. my understanding of the policy was that as long as you remained in employment within the NHS (any trust or department) then you retained continuous service and maternity rights. I can hand in my notice whilst on mat leave (if i get another job) and not have to pay anything back

The Trust is your employer - but its NHS service which counts for maternity rights, so as long as you remain with the NHS as fledtoscotland says you retain your continuous service and maternity rights. I think that he Agenda for Change handbook should cover this? You'll find it if you do a google

It is NHS service that counts.
You wont have to pay back as long as you return to an NHS job.

Thanks for all the answers. Seems like everyone is agreeing that it's my years in the NHS that count, so that's a relief. Now I can be a bit less worried about having to relocate
