Redundancy notice periods advice needed please!!

I was supposed to be made redundant later on this year, but I am now pregnant.

The redundancy agreement states that if you go on mat leave before being given notice then it will be given when you return from mat leave. If you go on mat leave in the middle of your notice period then it will be suspended until you return.

My question is about the second scenario. If I take a years mat leave then will my notice period and redundancy payout continue as it was or should another year's service be added to the notice period and payout?

Thanks

What your redundancy policy says isn't the legal position, they are under no obligation to do either of those things, and it sounds a bit unusual and unnecessarily complicated tbh, although good for people in your situation obviously.

Regardless of that, the notice you are entitled to and statutory redundancy pay you are entitled to depend on actual length of service, and service includes maternity leave, so if you don't leave employment until after further maternity leave your notice and statutory redundancy pay will reflect that.

Any redundancy pay they offer over and above statutory is subject to their own terms and conditions so you will have to ask about that.

The redundancy policy states that they will give twice the statutory notice period, so it looks like that will increase.

The redundancy payout isn't so clear.

I don't really want to ask HR as I don't want them to know I'm pregnant yet and it might highlight to them something that hasn't been thought about and they might try to serve me notice earlier than they might have done if I wasn't pregnant IYSWIM.

i might get a male colleague in another team to ask!!
