Hello, I work 2, 12 hour shifts a week, one week my employer asked me to drop a shift as she didn`t need me for that particular day. They paid me as if I would of done the shift all ok. I got paid normal wage in Dec. She has told me I have to make up the extra time I lost and has put me down for odd hours at the weekend this month and then in March! the hours are a different wage at the weekend and I will be owed extra money. Can my employer demand I make these hours up. I think working extra hours in March at the weekend is really annoying especially when it was in dec 08 that I was asked not to do 1 shift. Any advice please. PS theres nothing in the contract regarding this!

Bumping for you.

Your contract says nothing at all about overtime, changing hours, not being needed, anything at all like that?

Assuming your contract says nothing at all, and your contracted hours are fixed, money fixed, then if your employer told you not to come in that's not your fault and you should be paid (as you were). She can't decide later on that actually you should make the time up if it wasn't discussed at the time.

Thanks fbb, the contract does say I might have to work up to 48 hours as overtime in a week and regarding changing hours if agreed with the team leader or manager!. This leaves it very open I guess. There is a verbal arrangement that if a shift is dropped we would have to make it up usually within the month. I guess I would like to be paid the overtime in March and not be expected to use that time as my making up time. But I cannot approach my employer regarding this as they can get stroppy, literally!!. Even the manager is about as helpful as a hole in a bucket!

Well tbh if your contract says about overtime and also mentions changing hours, including a verbal understanding that hours dropped will be made up, I really don't think you can reasonably claim you genuinely thought that on this occasion you wouldn't have to make it up.

But if the pay rate at weekends would be more, at least ask for the difference to be paid to you.
