Teacher's maternity/holiday pay

cross posted as need some advice...
i'm a teacher in an independent school and baby is due at end of july. i'd like to go on maternity leave at end of june. school are offering me the statutory maternity pay arrrangements, i.e. 6 weeks at 90%, then SMP. But my query is this...what happens to my holiday pay? if i were not having a baby i would have july/august at 100% pay...why should i lose this just because i'm having a baby? do i have any rights here? as a teacher, doesnt my contract run september-august, therefore i have worked all year, so am entitled to holiday pay? any advice welcome!

I don't have the answer, but yes,I would have thought you should be entitled to have the holidays as 100% pay. Sorry not to be any help, but I hope it works out for you.

As a state school teacher I know that you are not entitled to full pay in the summer if you are on maternity leave, but not sure if it is different for you.

It's an interesting question, because teachers' salaries are for 9 months work, but it is paid in equal sums over 12 months. Therefore, if you have worked the full 9 months of the year, in theory, you should be paid the full salary. However, I don't know how that works in practice. I know that doesn't help, but I'm just thinking out loud!

I'm a teacher in the state system, but I started my maternity leave in the October and went back on the first day of the summer holidays , so it didn't affect me. I think I was paid 6 weeks at 90%, then another 6 weeks at 50%, then SMP.

In the state sector you wouldnt get paid for it. I started mine Sept 1st.

haha ' teachers salaries are for 9 months work'...do you do just 9 months work? i'll come to your school! i seem to spend most my holdiay catching up on paperwork, and then planning and prepping for the term ahead. although i'm sure my dh would like your opinion, he always says i get too much holiday compared to his 20 days.

just been reading on nut site, state teachers get 4 weeks full pay, 2 weeks 90%, 12 weeks at 50% plus SMP, then 8 weeks SMP...is that correct? might ask my school to follow suit.

if school want to do statutory pay, 6 wks at 90%, then shouldnt they have to adhere to the other conditions of statutory pay, including the accrument of holidays? can hey just pick and choose??

Yes, teachers are paid for term time only. Our contract is 1265 hours of directed time spread over term time.

I can't answer you specific question but I know the rules are quite specific so suspect it may be 90%. it is meant to be because you are not travelling.

for example on my first maternity leave the salary calculation included a month I had a bonus so 90% of the calculated amount was actually more than 100% of my normal salary IYSWIM

Those figures sound right dbm - I had forgotten about the full pay bit at the beginning. I thought it was 6 weeks on half pay, but obviously not.

I would recommend that you work up to the end of your school year and start your materinity leave as late as possible.

Basically, try to get your holidays in line with every other teacher, and take your mat leave during termtime.

When I was teching and on mat leave (state system), my DD was due end of February. I worked until the end of the autumm term, but didn't start my mat leave until the beginning of January.

Can you take the pre baby bit as holiday instead ? Then start ML as soon as baby arrives. That way at least you'd get some on 100%

I think that it is correct that maternity leave starts on the day the baby is born, if you arent already on mat leave.
