I'm on sick leave after been diagnosed with depression and am going to hand in my notice

Just wanted to check that because I am on sick leave I will lose any holidays I haven't taken is that correct?

I'm signed off for 4 weeks, I am contractually obliged to give 3 months notice. I don't particularly want to go back in as the working environment and job is a significant contributory factor as to why I am depressed and my GP has indicated she will sign me off for as long a I need to.

Any advice, comments about anything I should be aware of?

In my company you continue to accumulate annual leave whilst on sick leave, I thought this was standard. Do you have a copy of your original terms and conditions or even your companies absence from work policy to refer to?

Your company should look into whether there are any reasonable adjustments they can make in light of your illness to help you to return to work, and this may include a referral to occupational health. Would you consider allowing your company to explore this option before you hand in your notice?

No - they've already rejected my application for flexible working(i.e. working part time) and will not allow me to work from home which are the only ways I might consider keeping the job.
I live too far away as well - it's a 70 mile round trip and moving lose is not an option even in a better economic climate as DH has a long commute in the opposite direction.
The commute was doable before but with nursery pik ups and drops it was becoming very difficult.

a few years ago I was off work with stress related depression caused by work.

I too decided that the best thing for me would be to leave, so whilst signed off sick i gave my notice. i received all my holiday pay that was owed to me.

Holiday during sickness is complicated. As far as I am aware at the moment , you do have the right to accrue statutory holiday entitlement during long term sick leave, and it should be paid to you if you leave employment.

I think that's the current situation. Will try and look into it to make sure a bit later on. Have you got any reason to think your employer will try to deny you your holiday?

No I don't think they would just wasn't sure how it worked as I have never been in this situation before.
I'm hoping that they will pay me my 3 months notice but allow me to officially finish with them when this sick note runs out so I can get on with looking for another job.

They are very unlikely to pay you 3 months but release you early I would think. If you want to go earlier they may well allow you to do that but if you are resigning there's no obligation or need for them to pay the full notice period if you are no longer employed.

And of course if you asked to be released early and only serve one month of your notice period, you will only be entitled to be paid for one month's worth of holiday.

Check what insurance policies you have on your mortgage, credit cards etc. If you hand in your notice you won't get any Payment Protection.

I haven't asked them to release me early, I have to give them 3 months notice.
But my boss did say he would asked his boss if I could finish at the end of the year and still pay me the 3 months.
I don't have anything with PP except the mortgage and we won't be claiming anyway so it's irrelevant - we can cover the bills with DH's salary and some more belt tightening.
I'll be looking for a new job once I find out when my official termination date is.

However you said you were hoping they'd pay you the three months but allow you to finish when the sick note runs out, which would presumably be sooner than that. I thought you said it ran out in 4 weeks. FInishing sooner than 3 months would be releasing you early.

It's lovely of your boss to want to get you extra pay, but I think you would be extremely lucky to get them giving you a termination date of the end of the year and still paying you until February or whenever.
