Change of contracted hours

Hi all,

Im a bit worried about my job at the moment. Its in a shop and I have a 16 hour contract. There is talk of the opening hours of the shop changing which would mean hours will be cut and some people wont have a job anymore.Im due to go on mat leave at the end of Feb.

My question is, if this happens, do they have to give us notice? If they change my contract can they just do it and it will take effect straight away or do they have to give me notice if you see what I mean. Its not going to close down or anything, that I know.

Thanks.

Im in Scotland if that makes a difference.

girly technically a change to your terms and conditions, as this would be, must be agreed by both employer and employee, so technically you could refuse.

However in a situation like this it's obviously a bit different in practical terms and isn't something anyone can do anything about.

What they should do is consult you, so tell you what the change is they propose, listen to your suggestions or comments and then make a decision.

There's no specific notice period required for contract changes. If you refuse to accept the change what they can do is give you notice that they are going to terminate your employment and then re-employ you on the new terms and conditions, so in that case there would be notice of whatever your notice period is.

Have a read here and here.

Hi Flowery,

I thought as much,

I think im just going to go on Maternity leave asap and run away before anything happens. I doubt I will be able to go back anyway.

Thank you.

xx

Sounds very sensible. Remove yourself from the situation, enjoy your maternity leave, and then afterwards, you can find out what the situation is then, and decide whether you want to go back and on what basis that would be.

If you are entitled to SMP, the amount you get won't change if your hours are reduced as long as it's after you are 25 weeks pregnant.

Am 22 weeks now, I doubt they will do anything over xmas and new year so I should be safe for now.

xx
