Can they refuse my request for 3 days per week given that is what mat cover is doing?

I am due back at work in March and would like to go back 3 days per week. When I broached this subject during a face to face meeting with my manager in October his initial reaction was that he thought this could work, but I think he is now backtracking following an email exchange last week where he was suddenly being non-committal and now a request for me to meet with him, his manager and HR to 'agree something that works for us all'.

I'm not sure if they have reasonable business grounds for not allowing it. My maternity cover has been working 3 days a week since March doing the job, and one other team member works 2 days a week (slightly different role but similar enough). Given this, is there any way they can still find legitimate business grounds for making me work more than 3 days a week?

What complicates it is that there was a huge reorg just before I went on mat leave so this is a completely new job that i have not done before (it started the week after I went on mat leave). So my mat cover is the first person ever to do the job. In effect I feel she has set the precedent for how many days the job can be done in, but I obviously have no personal experience of whether I personally can do the job in 3 days.

I expect he is backtracking a bit because his manager and/or HR quite rightly don't want him to specifically agree to something without going through the proper procedure.

In practice, if your proposal means the job will continue to be done exactly the same as it has been done (presumably successfully) for the last 9 months, it would be extremely difficult for them to come up with business grounds to refuse it.

I agree with Flowery. On the other hand, I suppose if three days has been a disaster for the last nine months, that might be a reason why they are reluctant to make it permanent...

True, if it's been a disaster they have ready-made business grounds for refusing.

Thanks ladies. I'll try and find out a little more about how it is really going with my mat cover. She is someone who used to work in the department and has good relationships with people, knows the environment etc., so I imagine it has been going well, but I guess there may be bigger issues given it was a new role etc.

Just a bit nervous about the meeting ending up being me versus boss, head of dept and the dreaded HR

I'm sure it will be fine. Are you bringing anyone with you to the meeting for moral support?

I second what Flowery said, are you taking a colleague to the meeting? Sometimes it helps mentally to even up the numbers, even if your friend says nothing!
