To cut a long story very very short. I was made redundant while on Mat leave and won my case for both Unfair Dismissal and SD. My Employer submitted their appeal 2 days before the deadline, but it was not lodged properly as they did not include all the relevant documentation. They applied for an extension of time and I had a chance to comment. THEY then got a final chance to comment before the Registrar considered their application. They found that there was no exceptional circumstance causing the late submission and their extension and therefore right to appeal was refused. They then had a chance to ask for a review, which they did of course. It is now to go to a full hearing in front of a judge sometime in the next 12 months - waiting for date at the moment. I am now in situation where I won my case 6 months ago, still have not received my award, due to pay my solicitor which I can't afford to do without my award and am now representing myself. I expect that the Judge will uphold the Registrar's decision as it is quite clear cut, but it is quite unbelievable that the proceedings can be so protracted. I would encourage anyone to stand up for their rights and fight their case but be prepared for a battle. I am from an HR/Payroll Employment Law background and even I was completely naive as to how protracted these proceedings can be. Can the judge award additional cost in respect of interest and further legal costs? Also as the hearing is only to hear their case for extension of time, I assume that it will be up to them to provide most of the evidence. Can I produce written submissions to make sure that I don't leave anything out as I'm sure I will be quite nervous on the day? All I will be doing is quoting case law - already quoted in my objection letter and the registrars decision. Any guidance will be greatly appreciated.
