Redundancy - Part Timer needs advice !

What do you think my friends rights are....

She has worked for the same company for 14 ish years - 11ish full time then 1yr maternity and since part time.

She has just been made redundant and the calculation is 2weeks pay per year worked on her current part time salary.

Is there any way she can get more (I'm thinking along the lines that most part timers are women and she has been 'disadvantaged')

If there are any lawyers out there who can help she would really appreciate a response!

If she's getting two weeks pay per year rather than the statutory one week it's a system her employer has put in place. Like enhanced maternity pay, if they are offering a scheme more generous than the basic requirement, they can more or less put whatever conditions they like on it.

She hasn't been disadvantaged as she works part time and her payment in terms of wages and in terms of other payments should reflect that. It wouldn't be fair to full time staff for part timers to get the same settlement, and they have to draw the line somewhere in terms of how they calculate. For statutory redundancy pay this is usually the week's pay on the date notice is given, I am assuming her employer's enhanced scheme has a similar calculation date.

She could appeal to their better nature and ask for an additional payment to reflect her previous full time service, but they're certainly not obliged to do so, particularly given they're already paying more than they are required to by law.

She could think of it in terms of compensation for loss of earnings. Her loss of earnings would be less than someone working full time, so her redundancy payment should be less.

As Flowery says... Redundancy payments are to compensate for lack of current not previous salary.
If however she feels she has been made redundant BECAUSE she is part time then that's a whole different kettle of fish. (I've been there and done that..lol)
