Any hr can help urgently regarding leaving date

Hi all. My team lead wasn’t around for a few weeks when I wanted to hand my notice in so I was advised by another team lead to hand it in to her manager. No problem handed it in with my leaving date.
since then my team lead has got it in her head I am leaving a week before my leaving date. When I mentioned this to her she has continued to double down and say no it’s the week before and everything is arranged for me to leave the week before . Her manager is backing her and saying tough basically. I cannot afford to leave before the end of the month hence me writing in my resignation the original date at the end of the month. They are both basically saying tough they’ve arranged for me to leave the week before and that’s that. I’m absolutely fuming and really anxious about having to find a whole weeks wage to cover the week I’m being pushed out

Do you have anything with your leaving date in writing?

Tell your manager that's the wrong date and they'll need to change your leaving date. If no luck go to your HR dept if you have one.

Did you give your resignation exactly one month (or whatever your notice period is) before your end date? Or did you give it early and basically notify them a week earlier than you needed to? If the latter they may have calculated the notice period starting from the day you gave it, instead of the end date you wanted. Which is a mean thing to do but I don't know if you have any comeback on that.

Do you have an HR department? If they have just messed up the end date I think you are legally still employed until the correct date and should get them to rectify it.

I am an HR professional, if you put a leave date in the letter then that is the date your employment should be ended, unless something else was agreed when they accepted your resignation. If they are bringing this date forward without your agreement, they are effectively terminating your employment & if you have more than two years service, it will technically be unfair as they are not following a process to do so . If they have an HR function i would challenge through them, as a lot of operational managers would not understand this.

I wrote a date not ‘eight weeks’ for instance from the date I resigned. I’ve contacted hr but my service lead is telling them I agreed to leave a week before which I did not! I have the email letter to my service lead and her email accepting this

Whilst you can agree to change the date they don’t sound like they have much leg to stand on if nothing has been confirmed in writing

Did you provide more notice than required, e.g. you needed to give four weeks notice but gave a date six weeks away? Are you actually at work, or on sick leave, holiday or out of the office for some other reason? Contact your union for help.

However, if it suits the business better to have you leave on an earlier date, as indicated by xx, then you would be happy bring your last working day forward and to accept pay in lieu of notice for the remaining period.

Well, in that case, they need to honour your original leaving date then. Unless they are telling you that they are dismissing you before that date? Have you been employed there for more than 2 years?

Have you told HR that the date your manager is saying you are leaving has not been agreed and the date on your email/letter is the date you will be leaving?

Just keep turning up for work whatever they say. If tgey don't pay you put in a claim for "illegal deduction from wages" through employment tribunal. They will have to pay you.

Get advice from ACAS before doing anything.

You have written evidence, so go back to HR and ask them to deal with this. They need to give your manager the correct date. Tell HR that your manager is lying about an earlier date, that you have it in writing what your leaving date is, and that you won't be bullied into leaving any earlier.

I had to do this in my last job, I literally worded the email exactly as advised - funnily enough they came back to me and said oh it's ok you can work to the date you told us.

You NEED to put in writing the date you requested is the date you are sticking to and have not agreed to alter this.

I agree with the others. If you put a leave date in your letter then that is the date that stands. They can (depending on your contract) make you take any accrued annual leave but if they wish you to leave early they have to pay you.

Do you have an HR or a payroll deparment? I run payroll and whilst we don't have an official HR department if anyone came to me with your situation I would be telling the managers tht the company has to pay you until the date that you specified in your letter.
