Bank holidays possibly counting as taken when I'm not working

Bank holiday question.
I am on long term sick leave. My last day was right at the end of April and the bank holidays that will happen while Ill be away are the two in May, and one in August and hopefully I'll be back before Christmas. I work for this place where the HR department consists of one lovely but over- worked person, with whom I'd say I'm on good terms. She hasn't been there for long, is up to her eyes in implementing a new HR database and I'd heard of a number of hiccups so far. I don't know the details so maybe it was more of a gossipy thing really. And now I've got this awful sneaky idea that the bank holidays for the year may be set against, as in used up within my holiday allowance despite the fact I'll not be on leave. Which surely wouldn;t be correct.

Shall I just calm down and worry about it later? I don't know why it's bothering me. Can anyone put my mind at rest that it's not going to happen. I only get the part-time equivalent of 20 plus 8 bank hols and for some crazy reason it's getting to me. How can I relax?

I'm not really sure what you're asking here - do you think your total leave entitlement (your a/l plus your p/h hours) doesn't include your p/h hours? Or that she's deducted your p/h hours from your total leave hours even though they weren't days that fall on your normal working pattern?

Surely you should be contacting her to clarify?!

If they are in addition to your minimum holiday you will lose them .

That not necessarily true - it depends what the leave policy says.

If I'm on sick leave then to my thinking, I can't be said to be benefitting from the bank holidays. When I get back to work, I'm hoping that the 28 days pro-rated, won't be reduced by the bank holidays if I'm off sick when they happened. That can't be right, sirely? Hope this makes sense. Got no sign they will be so far, I guess I'm just over-reacting too soon.

Kindly, is this worth worrying about? You will be back at work with around half of the financial year left and a whole year's worth of annual leave to take. You can discuss then whether you still get those 3 days. Do you normally work Mondays, so would book those days off from your BH entitlement?

It's a tricky one, because if you were full time, your AL would probably just be '20 days' and then automatically taking the BHs, so doubt they would add them on if you missed them whilst off sick.

I cross posted with this message. If you have no evidence of any issues then just leave if for now. They probably haven't even thought about your leave, and the new person will be more experienced when you return and can figure it out then.

Most part time workers have their leave allowance calculated including BHs as a proportion of FT workers incl BHs so it's fair when including non work days on different day.

If a FT employee is off sick on a BH, they're not going to be given an extra day's leave to take at another time, so the same should apply to PT workers.

It probably depends on the policy where you work. Where I am, if you're off sick over a bank holiday, you get them back in leau. However, other organisations could have different policies.

You will be entitled to carry over any holidays, including bank holidays, that you weren't able to take in the leave year due to illness. This really isn't worth worrying over now - it can be sorted out on your return.

In the system for recording annual leave the bank holidays would likely be pre-booked as annual leave at the start of the year, in mine they just look like days booked off, so I am fairly sure it will be obvious to the person verifying how much leave you are owed that the bank holidays are part of that. I am not sure if a full time person would see the same, probably. Try not to worry about it and concentrate on your recovery.

In my place you have to book off the bank holiday from your public & privilege allowance so if you’re off sick, you wouldn’t need to book it. You should challenge if it is taken

Thanks everyone..I'll wait to find out what they're doing. The message does seem to be, as I was thinking, if I'm not working I shouldn't "lose" the bank holidays. Cheers 😃

Depends if you get Bank Holidays in addition to statutory annual leave and company policy .I work for the nhs and if you are sick on a bank holiday you lose the day .

It will definitely depend on the company’s leave policy
I have worked somewhere you would carry your AL into your return
And another organisation where you did not accrue BH if on sick
