I think i might be going mad.

A person is taking 2 weeks annual leave. Each week is marked on the rota as using 37.5 hrs leave so a total of 75 hrs. However the person is working from midnight until 8 am on the first day of their leave. Should this 8 hrs be deducted from the total hrs taken as leave? I think it should but the manager is saying no. No matter which way I look at it I cant work it out. Can someone in the know help me out please?

When does the working day start and end? It sounds to me like they are working on the Monday then off from Tuesday so not getting 37.5 hours off?

They work midnight till 8am. When they clock off their holiday starts. It technically starts with their non working hours from 8am to whenever they should be in again. Annual leave covers the hours they would work.
If they are working as you say why would it be annual leave?

Of course it should. They've worked 8 hours on day one.

If their holiday is 01/07/26-14/07/26, and they work from 00.00-08.00 on 01/07/26, their holiday is actually from 02/07/26-14/07/26, isn't it?

It sounds like they are working the Monday. Unless it's the last bit of a night shift which started on Sunday and therefore may count as working Sunday. Either way it would make sense for holiday to start from the Tuesday.

The shift starts 9pm on the Sunday and ends 8am monday morning. The first 3 hours are on the week before. Its shift work, no set days just a 37.5 hr week. Both weeks are marked as taking the full 37.5 hrs.

If the holiday started from the Tuesday would that mean only 29 hrs AL taken? As the next week no hrs are being worked and thats marked as 37.5 hrs taken too

So it's 11 hours, 3 in the previous week and 8 in the week they are off the rest of the week? The new week starts at midnight Sunday night?

If so then to me they are working 8 hours that week.

Yes the new week starts at midnight. The boss says im wrong asking for the 8 hrs but is unable to explain why. Everyone I have asked including mums net so far is thinking the same as me. I will go back to her and ask again. If I dont get an explanation im thinking of taking it further. I dont see why I should lose out for working the Sunday/Monday shift. I was hoping the 8 hrs would be taken off the week following my AL so that id get the hours back that week but the new rota has been posted and thats not the case.

If you include midnight to 8am on the Sunday, have they worked 37.5 hours (29.5 + 8) on the previous week, or 45.5 hours (37.5 + 8)? It would only make sense to ignore the 8 hours if the previous week was short.

No the week before I have worked my full hours up until the Sunday midnight.

You need to count the hours, not days. If the shift finishes at 8.00am on the Monday the A/L starts when their next shift would start if they weren't on A/L.

I would say that’s correc. The 8 hours on Monday is a Sunday night shift and would be counted in the previous weeks hours.
Is there a digital system you use that calculates it for you?

Your manager is sadly a bit hard of thinking. You are of course right. If she is counting the Monday as annual leave then tell her you're knocking off at midnight on Sunday 😠
