Incorrect Report of Wages

Hello,

My ex employer reported my wages incorrectly and has left me in financial hardship but they are adamant they have nothing wrong.

They did not report my wages in October, November or December and instead reported my YTD figure as a whole for January after I left, then reported my YTD again in February even though no payroll should have been ran for me which made it look like I'd earned all that in January then February to Universal Credit, leaving me with a nil UC claim. The stress has been unbelievable, I've asked them several times to correct their mistake and when I called HMRC to report this incorrect reporting they suggested talking to ACAS so I applied for early conciliation as advised.

They also failed to pay sick pay.

Will I get anywhere with the EC? Is what happened even an employment law issue? I'm still waiting to be allocated a conciliator. Just seeking some advice really.

I am confused!
If you earned nothing in February February, then your Feb year ytd would be the same as it was for January! What dates were you off sick?

The first thing you need to do (if you haven't already) is sending an urgent review request to UC via your journal. You will probably need to upload your payslips for each month but you should get your full claim backdated eventually.

Next is your ex-employer's error. They are supposed to report payroll to HMRC monthly, so they have definitely done it wrong.

Re the submission in Feb, unfortunately this might be HMRC's fault. There has been a glitch in their software this year which has led to numerous employee records being duplicated. However, this isn't something you can fix with them. Your ex-employer needs to raise a PAYE dispute with them - they can do this online. It would be in their interests to look into this as HMRC may have charged them double tax and NI for that month.

I am too! But its been reported that I earned the YTD figure each month.

I was off sick till from 2nd-23rd January.

I have already done all of the above, with disputes with all three parties. I've just been told to sit and wait by UC as there is no official timeframe for RTI disputes. My ex employer is adamant they have done nothing worng and HMRC are adamant its the employer, employer are refusing to raise a PAYE dispute and apparently I need to do it.

The stress is unbelievable and I just don't know what to do with two children to care for.

I have already escalated it with UC and I'm still being told to wait. Jan took 8 weeks to sort and they haven't even looked at Febs issue.

I haven't received a p45 no, on my personal tax account it says the employment ended on 23rd January but payroll has been ran for me in Feb and March too, I just don't understand.

I've pestered and pestered for it to be sorted and I am getting tired of being told to grin and bear it when it isn't my error and I have children to take care of.
