Work cutting hours - where do we stand?

Hourly paid employees. Contracts state “your hours of work will be X hours per week and where possible your days of work will be A, B &C but these days are not guaranteed” - the number of hours and the days are different for each employee.

If the business decides to completely close one day per week, should it automatically be the staff with that day mentioned in their contract that have their hours cut?

Contractually by that wording I would say yes but if they’re reasonable they would pro rata it amongst all staff.

They can't just unilaterally change your total hours of work. This is a redundancy situation ... unless you agree.

Ive been asked to agree to it - that’s what I’m unsure about. It’s being floated as a “temporary change” during a quiet period.

By that wording I’d say the number of hours are contractual but not which days those are worked.

That would mean the employer ca. adm the staff to work on any days but cannot reduce their hours without changing / breaking their contracts.

It’s not redundancy, the jobs are still there. It’s a variation to the contract. You can leave or agree to the changes or negotiate for a contract that suits you.

When you say hourly, are you on a fixed hour contract or zero hours?

Fixed hours, they have to pay your hours, if they shift when your hours are and your are happy - well and good. If you arent, it comes off accrued holiday

Zero hours, your hours can be cut for when you want them, but can be offered on differing days /times - your choice
