Can a notice period be removed if you are off sick?

Morning
Just wanting to know where I stand. I have been off sick and I have had to hand my notice in as can't return due to becoming disabled
So I have handed my notice in whilst on sick leave . My last official working day should be 27th October as per the 4 week notice period in my contract.
But I have checked my online pay portal today and they have put the end date in as the day I handed my notice in.
Does this mean that they are not expecting me to "work" my notice and have just ended the contract? Is this something that they can do as I was expecting another month's sickness pay.
If this is normal then thats fine but I have had no communication from them and would have been waiting for a wage on pay day that wasn't coming

Not normal, if sick pay is part of your contract. However - did you give them a month’s notice stating and end date, or just say you couldn’t come back - if you resigned without notice they may have just accepted that.

I told them I wouldn't be going back in as I was off sick but it wasn't resigning with immediate effect

Unless they’ve misinterpreted how you communicated you wouldn’t be returning i’e. ‘I’m not coming back’ vs ‘he’s my four weeks notice, my last day will be 27th October’ you are entitled to notice pay as confirmed in your contract. The duration of your notice period, and the payment due (it might be SSP only, and your earnings and duration of sickness will determine whether you are due anything) will depend on what your contract states. Have you had anything in writing confirming acceptance of your resignation.

Contact your union.

Did you confirm you were giving x weeks notice though?

Respond in writing with a clear date - handed my notice in on X date, per my contract which says here I have X weeks notice, my understanding is my last day is X; here is my sick note which confirms I am unable to work during that period.

No, it can't be removed unless they are paying in lieu in which case you'll get all the notice pay you were entitled to but finish date is sooner. They should discuss that though not just do it. Sounds like a cock up.

If your notice is four weeks, then they should pay you your four weeks.

However, how is your sickness worked out? Have you exceed your sickness allowance for the last twelve months?

Carrotsandgrapes · 03/10/2025 10:47

Assuming your resignation letter clearly stated your end date and couldn't be interpreted as you wanting to leave with immediate effect, I'd check:

  • If they're planning to pay you in lieu of notice
  • If you still have any sick pay remaining (normally you get X weeks full pay, X weeks half, then nothing).

But my understanding is that normally a reduced/no notice period is only by mutual agreement.

I work in a school, there is no department I can really ask. I have emailed someone but not heard back yet.
In my letter I included 4 weeks notice as per my contract and but that my last working day would be 27th October.
They have already removed me from email access.
The head replied to say she accepted my resignation and I have not heard anything since. I just so happened to look on my wage portal
